In this decision, the Oversight Board considers two cases together for the first time. Two separate pieces of content were posted by the same Instagram account, one in 2021, the other in 2022. The account is maintained by a US-based couple who identify as transgender and non-binary.

Both posts feature images of the couple bare-chested with the nipples covered. The image captions discuss transgender healthcare and say that one member of the couple will soon undergo top surgery (gender-affirming surgery to create a flatter chest), which the couple are fundraising to pay for.

In at least one of the cases, the post was sent for human review by an automated system trained to enforce the Adult Nudity and Sexual Activity Community Standard. This Standard prohibits images containing female nipples other than in specified circumstances, such as breastfeeding and gender confirmation surgery.

This policy is based on a binary view of gender and a distinction between male and female bodies. Such an approach makes it unclear how the rules apply to intersex, non-binary and transgender people, and requires reviewers to make rapid and subjective assessments of sex and gender, which is not practical when moderating content at scale.

The restrictions and exceptions to the rules on female nipples are extensive and confusing, particularly as they apply to transgender and non-binary people. Exceptions to the policy range from protests, to scenes of childbirth, and medical and health contexts, including top surgery and breast cancer awareness. These exceptions are often convoluted and poorly defined. In some contexts, for example, moderators must assess the extent and nature of visible scarring to determine whether certain exceptions apply. The lack of clarity inherent in this policy creates uncertainty for users and reviewers, and makes it unworkable in practice.

Meta should seek to develop and implement policies that address all these concerns. It should change its approach to managing nudity on its platforms by defining clear criteria to govern the Adult Nudity and Sexual Activity policy, which ensure all users are treated in a manner consistent with human rights standards. It should also examine whether the Adult Nudity and Sexual Activity policy protects against non-consensual image sharing, and whether other policies need to be strengthened in this regard.

I had to reply further, I am so angry. I feel like all these years of supporting my son with his autism has been disregarded by the medical profession, the NHS itself. So much advice and support put into his health and well being from a baby and now a total disregard of these issues when he discloses the trans-gender identity problems.

My son is also now involved with a couple of friends at college who are into Cosplay and Anime, he has become hooked on the Anime films and costumes, one of his friends is making him a dress for an event where people can go dressed as their favourite characters if they wish. My son is absolutely loving the attention and has stated that since he came out as being trans, that it has won him much love from some of the students, particularly the girls.

I can see where you identified the mental health concerns with your son, if pushed into a stressful situation, they can very easily have breakdowns and it was clear that he was in a crisis and the self harm for our kids is a very real concern.

Also, I noted that you said your husband has very old fashioned ideas about fatherhood, this is similar to my situation. I do actually call my husband a Victorian for fun! He is very masculine, his son from a previous relationship is a boxer and again, testosterone bound! I remember Jacob witnessing many a fuelled row between my husband and Stepson when we lived in Birmingham and do believe it frightened him to death, I used to remove Jacob from the situation whilst the males fought! It sounds horrendous but just a slightly raised voice used to rattle Jacob with his sensitivity, I want to explore if this had a profound effect on him first too before we go down the trans gender option.

I am back in the Tavistock centre with Jacob tomorrow and am wishing I could be home with my daughter who has had a traumatic week, she has to go back to school tomorrow after some bullying and I desperately want to get the balance of attention right too, Jacob takes up so much of my time it is exhausting and I feel that this transgender stuff is another way to get my undivided attention too which I do have moments of great resentfulness over.

Thanks for sharing your story and I hope things improve after the Christmas you have endured. I will let you know how the appointment goes at Tavistock as I will be asking questions tomorrow, we need to make the right decisions and not be influenced by the press and medical profession to rush things.

Enjoy them and protect them from it all as much as possible, they will learn about all this in school anyhow regardless of what your son has gone through, you cannot protect them but keep everything on a need to know basis only.

I am so sorry to hear that you are still going through a huge amount of challenges, it is tragic that someone has to reach rock bottom and need sectioning before anything is done. On a positive note though, time is proving to be a great healer, four years in his life have evidently challenged his ideas on gender and his own identity. It definitely sounds like more complex mental health issues with him with the social obstacles even getting in the way of his gender identity connections, and you mentioned cults- it does feel as though the youth are all looking for some sort of identity and in varying ways forming their own little cults with various titles; all in the need of social uniqueness.

He is struggling tremendously with friendships still and only has me and his dad outside college which is sad but I am getting support from an Autism advice group on getting over some of these obstacles. It was easier when they were little to get them socialised, very difficult as adults.

I am thrilled you too have focused on everything else, I have tried this and it has worked. I emphasised that his career was the highest importance above everything else and he threw himself into his work which worked.

The NHS is too quick to diagnose and needs to do a lot more of investigation and therapies with these children without fear of reprisals from activists and groups who differ with their opinions. Huge changes needed.

I am an American mother of a high functioning autistic son who is in his late 20s. This story touched me deeply. My son never showed any signs of a transgender tendency until he burst out with announcing that he wanted a sex change operation when he was 26-He has been cross dressing now for about three years. It has been a terrifying experience and has seriously impacted our family. Fortunately, he had been seeing a psychiatrist for quite awhile before he mentioned wanting this change. This doctor is quite enlightened and was highly doubtful of the legitimacy of this sudden urge out of the blue. He has sent him to a therapist who specializes in this type of issue just to make 100 per cent sure that this is not just an obsession without any realistic base. We are still trying to sort it all out . Our son also suffers from mental illness. It is overwhelming to me a great deal of the time to try to sort out what is autism, what is mental illness, and what is reality. I would love to hear more from others dealing with this very difficult situation and would like to be of support to you as well. Thank you!

Actor and author Maulik Pancholy posted a video to Instagram thanking followers for their expressions of support after a Pennsylvania school board canceled a speech he was scheduled to give as part of an anti-bullying school assembly.

On April 15, the Cumberland Valley School District school board voted unanimously to cancel the assembly, scheduled for May 22 at Mountain View Middle School in Mechanicsburg, a town of 9,000 people just 10 miles west of Harrisburg.

The full panel of the 4th U.S. Circuit Court of Appeals ruled in favor of transgender plaintiffs in two cases from North Carolina and West Virginia, finding that existing insurance exclusions on gender-affirming care are discriminatory and unconstitutional.

Lawyers for the plaintiffs noted that this most recent ruling sets precedent, not only for North Carolina and West Virginia, but all other states within the 4th Circuit, including South Carolina, where state officials are considering a ban on gender-affirming care for minors -- one of the few Southern states without a ban currently in place.

A trans-identified male who promotes nudism has been reported to child protective authorities following a disturbing video beginning to circulate on social media showing him exposing his genitals and breasts in the presence of a small child.

In the video, an adult post-operative transgender male is seen lounging nude in what appears to be a family residence. The man spreads his legs repeatedly, exposing his surgically-constructed vagina, while a young boy is sitting a few feet in front of him. He then stands to retrieve a trans-pride flag which he holds in front of his body.
