Neither converters nor their representatives are allowed to sell the new motor vehicles they convert directly to Texas consumers, including municipalities. Only dealers that are franchised and licensed for the underlying line-make of the converted vehicle are allowed to sell converted vehicles to Texas consumers. If a converted new motor vehicle is sold through a bid process, a franchised dealer for the underlying chassis line-make must be listed on the bid as the seller.
The converter is not required to purchase the motor vehicle it will convert from a Texas franchised dealer. However, once the conversion is complete, the vehicle can only be sold to the end-user by a franchised and licensed Texas motor vehicle dealer for the underlying chassis line-make. The franchised dealer must invoice the end-user for the entire purchase price of the vehicle, including the conversion package, obtain payment for the entire purchase price, and perform the titling work on the complete vehicle. How the converter is paid for the conversion package and conversion work is between the converter and the franchised dealer.
If a person makes substantial modifications to a new motor vehicle and the resulting product is an ambulance, fire-fighting vehicle, or motorhome, as those terms are defined in Chapter 2301 of the Texas Occupations Code, then the person must obtain a manufacturer license, not a converter license. However, if even one of the conversions produced does not meet the exact definition of ambulance, fire-fighting vehicle, or motorhome, then a converter license, as well as a manufacturer license, is required.
Converters are not required to be physically located in Texas. Even if the converter is located in another state, as long as new motor vehicles they convert are sold in Texas, the converter must have a converter license issued by Texas Department of Motor Vehicles.
The California Air Resources Board, with assistance from aftermarket catalytic converter manufacturers, has been developing a database to store and retrieve information on aftermarket catalytic converters that have been approved for use in California. These catalytic converters comply with the new regulations that became effective January 1, 2009. The database is currently under construction and contains some of the catalytic converters approved for OBD II vehicles. Once finalized, it will also include catalytic converters for non-OBD II vehicles.

According to court documents, brothers Tou Sue Vang, 31, and Andrew Vang, 27, and Monica Moua, 51, all of Sacramento, California, allegedly operated an unlicensed business from their personal residence in Sacramento where they bought stolen catalytic converters from local thieves and shipped them to DG Auto Parts LLC (DG Auto) in New Jersey for processing. The Vang family allegedly sold over $38 million in stolen catalytic converters to DG Auto.
According to court documents, together the defendants bought stolen catalytic converters from thieves on the street, then re-sold and shipped them to DG Auto in New Jersey for processing. Over the course of the conspiracy, defendant Tyler James Curtis received over $13 million in wired funds from DG Auto for the shipment of catalytic converters and received over $500,000 from Capital Cores for catalytic converters. Defendant Adam G. Sharkey received over $45 million in wired funds from DG Auto. And defendant Martynas Macerauskas received over $6 million in payments from DG Auto for catalytic converters. In all these incidents, most of the catalytic converters sold to DG Auto were stolen, and DG Auto knew or should have known that when they paid for them.
Governor Kathy Hochul today announced new actions to increase interagency vehicle and catalytic converter theft enforcements in high-theft areas by targeting unauthorized and illegal vehicle dismantlers, or "chop shops." The Governor also signed legislation (S.9428/ A.1940-E) to combat the theft of catalytic converters, which imposes restrictions on the purchase, sale, and possession of catalytic converters by vehicle dismantlers and scrap processers.
"Public safety is my top priority, and we're taking an aggressive, targeted approach to deter criminals from stealing catalytic converters," Governor Hochul said. "Catalytic converter thefts have skyrocketed across our state and nation, and these comprehensive actions double down on our efforts to keep New Yorkers and their property safe, protecting our communities and cracking down on crime."
