This is correct Mr. Burnore: We have not requested that the site be
removed, as it does not appear to be in violation of any AUP, law, or lawful
regulation.
If you are still unable to view the site as a result of
mfn.org blocking your
IP range, you can access it via a proxy. I just checked and
he is not yet
blocking connections from www.anonymizer.com.
It appears that mfn.org is now getting connectivity directly
from saavis.net;

As I've explained previously, Jerry A. Terranson, the owner
of mfn.org, has
announced on Usenet his intentions to defy any order from the
state of North
Carolina to remove the site.
Savvis is unaware of any such claim Mr. Brunore, as Mr. Terranson has
offered (both Savvis and the NCDOJ) to remove any offending web site upon
receipt of any lawful Court Order. Regardless of your protestations to the
contrary, Mr. Terranson has been quite reasonable and cooperative.
Savvis: the site in question is in direct violation of your
AUP. Quoting

There appears to be no violation Mr. Burnore. He has a page up which
contains public information which is acknowledged as accurate by both you
and the North Carolina DOJ, namely, that you were convicted of some type of
sex crime against a minor child, and had your picture posted on the WWW by
the State of NC pursuant to "Megan's Law". That the content is presented in
a way that vaguely resembles the format used by the State in which you
registered as a sexual offender may or may not infringe on a copyright - it
is doubtful, however. Nevertheless, as Mr. Terranson has graciously offered
to remove the site upon notice by any competent Court, it is a simple enough
matter for you to obtain your desired result if you are correct in your
legal assumptions.
To put it bluntly Mr. Burnore, there is no information on the sites in
question which violate any federal, state, or local law. There is no
material which could concievably be protected under trade secret or
intellectual property statutes, and, as I have stated, the fact that you
actually _are_ a convicted sexual offender would not seem to fall under
"trademark" or copyright violations.

Mr. Burnore, the law you have cited does not appear to have anything to do
with the web sites in question. The statute you have referenced appears to
deal with persons emailing their victims, and not with the "victims"
choosing to view www pages that they don't like. To put this a little more
simply for you, the fact that you do not like a given web site does not make
it harrasment. That you have to actually take active steps in order to see
it does not make it harrasment. Since the information which you appear to
be objecting to is true, this web site is very likely covered by United
States First Amendment protections, and is therefore not harassment.

We have examined this site in detail, because of your voluminous complaints,
Mr. Burnore. This site is very clearly marked as a "parody". While it
clearly contains "untrue" yet quite humourous statements which are directed
at you and your wife, these statements are obviously not presented as
"factual". However, if you honestly believe that these statements are
libelous, you should consult with an experienced attorney - and not us.

appears to be a

Which proves what Mr. Brunore? There is no violation here. There is no
harassment here. There are no lies here (are there? You have not asserted
that you are _not_ a convicted sexual criminal, have you Mr. Brunore?).
There is simply no cause for Savvis to take action against.
Savvis: I ask that you instruct your client to remove the
sites immediately.

Mr. Roberts: I ask that you explain once again to Savvis why
their client
has no right to display the information at
http://www.mfn.org/thorne/defectgb2.htm.
Mr. Terranson has sent us a cc of an email between him and Mr. Roberts, and
it would appear that Mr. Roberts has agreed to apply for a court order if he
feels there is a violation of any applicable law(s). Until such time, Mr.
Terranson has every "right" to express his views and disseminate his
"information".
Lastly, I ask that Savvis *NOT* provide mfn.org with a copy
of this email as
he will post it to Usenet and on his website and it will be
used as a further
tool of harassment.
Mr. Burnore, this is the United States, where we have the right to face our
accusers: we provide all of our customers with copies of complaints made
against them. If you are so worried that Mr. Terranson will post copies of
your many obviously baseless complaints, perhaps you should stop
complaining?
