A new Attorney General’s Open Meetings Opinion has been issued:

Request: Whether the Burleigh County Commission held “meetings” through various means without providing public notice in substantial compliance with N.D.C.C. § 44-04-20.
Conclusion: The Commission did not hold meetings through various means in violation of North Dakota’s open meetings law. The individual conversations occurred before the newly elected commissioners officially took office, so they were not members of the governing body for purposes of forming a quorum. Only less than a quorum of sitting commissioners participated in the conversations, and the discussions were not relayed among a quorum of commissioners.
