On November 15, 1983, Avatar Properties Inc., formerly known as GAC Properties, Inc., entered into an agreement with Collier County, Florida, to donate 1,061.5 acres of land to the County. The lands deeded to the County under this agreement could only be used to provide governmental facilities for existing and future residents of Collier County, with all capital improvements to be physically located within the geographical boundary of Golden Gate Estates and any proceeds from the sale of these lands to be utilized for capital projects situated in Golden Gate Estates. Governmental facilities which would be able to be constructed on the property, or with the proceeds of any sale of the property include fire protection facilities, police facilities, public schools, libraries, recreational facilities, and equipment necessary for the respective operations. If the County allows the lands to be used for any other purpose, the ownership and title thereto would revert to Avatar Properties Inc.

The County has the right to sell or trade lands acquired under this agreement. Any land acquired by trade is subject to the same limitations that it is used for public purposes within Golden Gate Estates as described above. The Applicant has demonstrated that 1.49 ac of the project will return the disturbed area to a predevelopment runoff condition. The applicant will not be required to provide qualitative control controls for 1.49 ac of this project.
