Lynn met with the ADA yesterday handling Martin’s case.  I spoke with Lynn this morning.  She asked me to let you all know what she found out.  

The driver is still in jail and likely to remain there until her trial. The Grand Jury meets tomorrow and will indict her on two felonies: 1) Hit and run resulting in death 2) Death with DWI. The trooper had charged her with additional crimes but the ADA went with these two most likely in plea negotiations.  The driver has pled guilty to these two charges so only the sentencing phase remains.  The sentence, if convicted on both, would range from 74 to 92 months.  The ADA will ask for the maximum.
 
Court date and time:  December 2, 2024 9:30 to 10:30.  Arrive by 9:00 AM if you plan to attend.
Court location: Wake County Justice Center Room 704

What can you do?  The ADA has invited statements from anyone wanting to say how Martin’s death has impacted them. She, the ADA, will read some (all?) of them at the trial.  There is also an opportunity to read your own statement at the trial but I’m not clear on that process yet.  What I do know is that if you want to write a statement, please complete it by November 15 in any format and email to Lynn at llas...@gmail.com.  The ADA asked Lynn to collect all the statements. Lynn will take them to the ADA’s office all at once.  Format:  most any:  PDF, Word, even email text.

P.S. I don’t have Iceman’s or Tim’s email.  Tim is tall with blond/gray long hair long pony tail. He’s standing between Rich and Gary in the group photo.  I don’t have Wendy’s either but Gary will take care of her.  

P.S.S. I would say this activity is the most important exercise our group has yet to do.  We need to have good participation, not only for Martin’s memory, but to show our support for the safety for the cycling community in general. Your statement doesn’t have to be (probably even shouldn’t be) long or complicated.  The number of people sending statements is more important than the total word count.
