Petition challenging the constitutional validity of the current practice of appointment of Chief Election Commissioner and Election Commissioners by Executive W.P (C) No. 000569/2021: 

On 17th May, 2021, ADR filed a petition in the Supreme Court challenging the Constitutional validity of the current practice adopted by the government in the appointment of Members of the Election Commission.  In addition, the petition also seeks a direction from the court for constituting a neutral and independent collegium/ selection committee for appointment of Members of Election Commission on the lines of the recommendations given by the Law Commission in its 255th Report of March 2015; Second Administrative Reform Commission in its fourth Report of January 2007; Dr Dinesh Goswami Committee in its Report of May 1990; and Justice Tarkunde Committee in its Report of 1975. In its petition, ADR has also contended that any practice of appointment of Chief Election Commissioner and Election Commissioners solely by Executive is violative of Article 14 and Article 324(2) of the Constitution
