Dear Friends,

Association for Democratic Reforms (ADR) and Maharashtra Election Watch have analyzed the criminal, financial and other background details of 272 out of 288 sitting MLAs. One Independent MLA namely Kishor Gajanan Jorgewar contesting from Chandrapur (SC) Constituency has not been analysed as his affidavit was badly scanned. In the current assembly 15 seats are vacant.

This analysis is based on the affidavits submitted by the candidates prior to the 2019 Assembly elections and bye elections conducted thereafter.

Summary and Highlights

Criminal Background
  • MLAs with criminal cases: Out of 272 sitting MLAs analysed, 164 (60%) Sitting MLAs have declared criminal cases against themselves.
  • MLAs with serious criminal cases: 106 (39%) Sitting MLAs have declared serious criminal cases.
  • MLAs with declared cases related to murder: 2 Sitting MLAs have declared cases related to murder (IPC section 302).
  • MLAs with declared cases related to attempt to murder: 10 Sitting MLAs have declared cases related to attempt to murder (IPC section 307).
  • MLAs with declared cases related to Crime Against Women: 12 Sitting MLAs have declared cases related to crimes against women. Out of 12 Sitting MLAs 1 Sitting MLA has declared charge related to rape (IPC Section-376).
  • Party wise sitting MLAs with criminal cases: 62 (60%) out of 103 MLAs from BJP, 25 (63%) out of 40 MLAs from NCP, 22 (58%) out of 38 MLAs from SHS, 20 (54%) out of 37 MLAs from INC, 9 (56%) out of 16 MLAs from Shiv Sena (Uddhav Balasaheb Thackeray), 6 (50%) out of 12 MLAs from Nationalist Congress Party (Sharadchandra Pawar) and 9 (75%) out of 12 Independent MLAs have declared criminal cases against themselves in their affidavits.
  • Party wise sitting MLAs with serious criminal cases: 38 (37%) out of 103 MLAs from BJP, 14 (35%) out of 40 MLAs from NCP, 18 (47%) out of 38 MLAs from SHS, 11 (30%) out of 37 MLAs from INC, 7 (44%) out of 16 MLAs from Shiv Sena (Uddhav Balasaheb Thackeray), 3 (25%) out of 12 MLAs from Nationalist Congress Party (Sharadchandra Pawar) and 7 (58%) out of 12 Independent MLAs have declared serious criminal cases against themselves in their affidavits.

Financial Background

  • Crorepati MLAs: Out of 272 sitting MLAs analysed , 252 (93%) are crorepatis.
  • Party wise crorepati MLAs: 98 (95%) out of 103 MLAs from BJP, 36 (90%) out of 40 MLAs from NCP,  35 (92%) out of 38 MLAs from SHS,  35 (95%) out of 37 MLAs from INC,  15 (94%) out of 16 MLAs from Shiv Sena (Uddhav Balasaheb Thackeray),  11 (92%) out of 12 MLAs from Nationalist Congress Party (Sharadchandra Pawar) and 11 (92%) out of 12 Independent MLAs have declared assets valued more than Rs 1 crore.

  • Average assets: The average of assets per sitting MLA is Rs.24.38 crore.
  • Party wise average assets: The average assets per MLA for 103 BJP MLAs analysed is Rs.28.99 crores, 40 NCP MLAs analysed is Rs.15.46 crores, 38 SHS MLAs analysed is Rs.21.15 crores, 37 INC MLAs analysed is Rs.27.18 crores, 16 Shiv Sena (Uddhav Balasaheb Thackeray) MLAs analysed is Rs.7.13 crores, 12 Nationalist Congress Party (Sharadchandra Pawar) MLAs analysed is Rs.20.86 crores and 12 Independent MLAs have average assets of Rs.19.28 crores.

Other Background Details
  • Education Details of MLAs:  109(40%) MLAs have declared their educational qualification to be between 5th and 12th standard while 151 (56%) MLAs have declared having an educational qualification of graduate or above. 8 MLAs are Diploma holders. 4 MLAs have declared themselves to be just literate.

  • Age details of MLAs:  131 (48%) MLAs have declared their age to be between 25 and 50 years while 141 (52%) MLAs have declared their age to be between 51 and 80 years.
  • Gender details of MLAs: Out of 272 MLAs analysed, 23 (8%) MLAs are women.
