Clarification on allegation of giving false affidavit of a voter by ADR during hearing dated 09th October 2025 before the Hon’ble Supreme Court

 CLARIFICATION

On 10th October 2025, there were a few media reports about the Association for Democratic Reforms (ADR). They reported that the lawyer for the ECI had pointed out several inaccuracies in an affidavit submitted to the Supreme Court. The Honourable Court also asked how they could believe in the facts. We thank the ECI lawyer and the Court for their remarks. ADR stands by its values of accurate dissemination of information. ADR has gained the trust of voters in the last 25 years for fact-based, non-partisan work. We would, therefore, like to set the record straight.

Through other sources, a document was handed over by our lawyer to the Court. To this document, the ECI's lawyer stated that the individual in question had never appeared in the draft list, adding that the person had failed to submit the necessary enumeration form, leading to their exclusion from the final list. We have checked this observation made by ECI's lawyer in the Court. The following are the correct facts regarding the allegation of giving a false affidavit of a voter by ADR during the hearing dated 09th October 2025 before the Hon’ble Supreme Court (SC): 

1. The said affidavit was never “filed” by ADR but was tendered across the bar in response to a query raised by the Hon’ble SC.
 
2. ⁠The said affidavit noted that the elector is a resident of 115, Shaheed Sthan Road, Gulzarbagh, Patna- 800007, having a Voter ID bearing EPIC No. YHX3046307, Serial no. 653, Part No. 52, FNS Academy High School, West Shershah Road, Patna, under 184 Patna Sahib constituency of Bihar Vidhansabha, Bihar.
 
3. ⁠All the above facts are correct, as can be checked on the ECI website. Thus, the assertion by ECI counsel that the said voter does not exist or that the EPIC belongs to some other individual is incorrect and misleading. In fact, ECI could have and would have easily checked these details through his EPIC number; instead, they asserted that he was a fake voter or that the address did not belong to him.
 
4. ⁠That with regard to the elector's statement that his name appeared in the draft roll, it is clarified that the elector/someone on his behalf had possibly checked his name on the "Draft Roll - 2025" of January 2025 on which his name was duly mentioned.  It is to be noted that both the “Draft Roll- 2025” and “SIR Draft 2025” have been published by the ECI on the same web link and same drop-down menu (as shown in the image below) available at https://voters.eci.gov.in/download-eroll?stateCode=S04. His details are available on the Draft Roll - 2025 for AC 184 Part No. 52 at Serial No. 653, and every detail furnished in the affidavit matches that record.

5. ⁠It is highly unfortunate that the said elector is being hounded, summoned, and threatened by the officials since the Supreme Court’s hearing dated 07.10.2025. This will further create more distrust, fear, and reluctance on the part of electors to come forward in case of their deletion from the electoral rolls or in case speaking orders have not been given to them.
