Movements across India call for putting river rejuvenation and
Riparian Rights protection on the election agenda
4th April, 2024: Representatives from diverse organisations based in different geographies of the country raised concerns about the developmental policies of central and state governments that have contributed to the commodification, privatization, appropriation and pollution of our riverine ecosystems in an online press conference organised on the 4th of April by the River Valley Forum – a process initiated by the National Alliance of People’s Movements. Bringing attention to the missing environmental issues which are side-lined over populist policies in short-sighted electoral goal setting, the speakers highlighted the fact that it is imperative that not only the state but citizenry turn their attention towards the urgent need to protect the interconnected jal-jangal-jameen natural capital in balancing our ecosystems providing life and livelihood security to every citizen of this country.
‘From the glacial rivers of the Himalaya to the Periyar we are campaigning for rivers to be recognised as living entities, and demanding strengthening as well as decentralisation of river governance to protect rivers and riparian rights of peasants – especially small holders, fisher people, nomadic communities and several indigenous and marginalised communities. For this purpose, we are releasing a draft of a proposed central legislation aimed at Protection, Conservation and Rejuvenation of Rivers and Riparian Rights in India along with key demands for political parties and parliamentarians, in the wake of the Lok Sabha 2024 elections’, said Medha Patkar in her address to the press. ‘We oppose the relentless constructions of dams, barrages, embankments, hydroelectric projects, widespread commercial and illegal sand mining, sewage and effluent dumping, interlinking and river front projects’, she added. The change in land use and hydrologies caused by these have affected both surface and the inter-connected ground water regimes in the country, dispossessing and displacing millions of their livelihoods.
Manshi Asher, of Himdhara Collective spoke how the growing density of dams and other mega infrastructures have turned the Himalayan region, reeling under the impacts of climate crisis, into a disaster zone especially floods for which 2023 was a milestone year. ‘The ongoing struggle in Ladakh is highlighting the urgency of the ecological crisis in the region’. The linked issue of mismanagement of transboundary rivers was further highlighted by Mahendra Yadav of Kosi Nav Nirman Manch, Bihar. ‘River embankments have been pushed as false solutions to control rivers and have become a cause of floods. The riparian communities have faced displacement and even mechanisms like the Kosi peedit vikas Pradhikaran have been only paper and have provided no relief or rehabilitation’.
Rajkumar Sinha from Bargi and Basania Bandh Sangharsh, Madhya Pradesh highlighted the twin problems of urban pollution and illegal sand mining on the Narmada and its tributaries. ‘Unless there is a public dialogue and involvement in governance we cannot address these questions’, he added and also highlighted how adivasis who conserve water bodies and forests more in scheduled areas are facing the brunt of extractive developmental policies. Speaking from the Mullaperiyar experience, SP Ravi from All Kerala River Protection Council raised the need for ‘people to people dialogue for conflict resolution instead of relying on politicians who only escalate the conflicts for vested interests’.
‘As we have seen in the case of the Sabarmati Riverfront case in the High Court – if we do not look at the natural river flows in planning then this is bound to create problems for the citizens’, added Krishnakant of Paryavaran Suraksha Samiti, Gujarat. Scarcities from problematic infrastructures and drying of rivers have led to growing interstate and inter-basin conflicts over sharing of water resources – like we see in the case of Cauvery, Mahanadi, Kosi (transboundary river) and other smaller rivers. The Press Conference was moderated by Mudita from Gujarat Lok Samiti who also drew attention to the nature of governance that is anti-people and anti-nature, exploiting, polluting rivers even as farcical exercises in the name of ‘public hearing’ are held, while the actual affected people are never heard !
Some of the key issues that are addressed in the proposed draft River Protection law :
⮚ Recognise the holistic importance of rivers as sources of life and advocate for development paradigms that prioritize river protection.
⮚ The urgent need for principles to address unjust encroachments (esp dams & embankments) and impacts on rivers, emphasizing the importance of aligning with existing laws and constitutional values.
⮚ Principles ranging from defining rivers by their water flow to protecting riverine ecosystems and ensuring distributive justice in resource allocation/ sharing.
⮚ Emphasize the continuous and unpolluted flow of rivers as a priority, with measures to prevent drying even in non-monsoon months.
⮚ Call for afforestation and protection of forest cover in river catchments, by stopping of illegal sand mining, and strict control of pollution from urban, industrial, and agricultural sources.
⮚ Comprehensive assessment and prevention of impacts on rivers and their ecosystems, ensuring consultation and consent of riparian communities in decision-making.
⮚ Address displacement concerns and advocate for fair compensation and rehabilitation policies for affected populations.
⮚ Establishment of a River Basin Authority (RBA) with expertise from various disciplines and representation from statutory agencies, civil society, and riverine communities.
⮚ Defined functions of the RBA, including planning, budgeting, execution, and monitoring of actions related to river protection and conservation.
⮚ Preparation of master plans for each river by inter-disciplinary committees, incorporating ecological and socio-cultural assessments and public consultations.
⮚ Outline the responsibilities of these committees, including the preparation of budgets, supervision of execution, and appointment of monitoring committees.
⮚ Legal and administrative actions against violations and call for regular surveys and research to ensure compliance.
The Online Press Conference on Riparian Rights, Riverine Protection and Rejuvenation: Defending Democracy & Upholding the Constitution was held in the light of the upcoming parliamentary elections, and it was stated by activists that the People’s River Protection Bill is being sent to all political parties and their MPs, to be included in their Manifestoes, and also to take cognizance of the serious issues being faced by our rivers and riverine communities.

देश के अलग अलग भौगोलिक क्षेत्रों के विभिन्न संगठनों के प्रतिनिधियों ने, जन आंदोलनों का राष्ट्रीय समन्वय: के राष्ट्रीय नदी घाटी मंच द्वारा आयोजित एक ऑनलाईन प्रेस वार्ता में केंद्र और राज्य सरकारों की विकास संबंधित नीतियों को नदियों के व्यापारीकरण, नीजिकरण, प्रदूषण और विनियोग के लिए ज़िम्मेदार ठहराया. साथ में इस बात को भी रेखांकित किया की चुनावी राजनीति में दूरदर्शिय लक्ष्य छोड़, लोक-लुभानि नीतियों का दबदबा रहता है और पर्यावरण के मुद्दे हाशिए पर रह जाते हैं। वक्ताओं ने इस बात की तरफ भी ध्यान दिलाया कि राज्य के साथ-साथ आम नागरिकों का भी दायित्व है कि प्राकृतिक संपदा –यानी जल-जंगल-जमीन के गठजोड़, जो हमारे पारिस्थितिक तंत्र को संतुलित रख देश के प्रत्येक नागरिक के जीवन-जीविका की गारंटी सुनिश्चित करता है, को प्राथमिकता पर लाया जाय।
‘हिमालय की हिमनदियों से लेकर पेरियार तक हम एक ऐसा अभियान चला रहे हैं कि नदियों को एक सजीव इकाई के तौर पर मान्यता दी जाए, और साथ में यह मांग कर रहे हैं कि किसानों और खासकर छोटे धारकों, मछुआरों, खानाबदोशों, चरवाहों और बहुत सारे आदिवासी, दलित और अन्य हाशिये के समुदायों के तटवर्ती अधिकारों की रक्षा के लिए नदीय प्रशासन को मजबूत करने के साथ-साथ विकेंद्रीकरण भी किया जाए’, ऐसा जन आन्दोलन के राष्ट्रीय समन्वय की नेत्री मेधा पाटकर ने बताया।
उन्होंने कहा, ‘2024 के लोकसभा चुनावों के मद्देनजर हम देश की राजनीतिक पार्टियों और सांसदों के लिए भारत में नदियों और तटवर्ती अधिकारों की सुरक्षा, संरक्षण और पुनर्जीवन के उद्देश्य से एक केंद्रीय कानून का प्रस्तावित मसौदा जारी कर रहे हैं’। मेधा पाटेकर ने पत्रकारों को संबोधित करते हुए कहा कि 'हम बांधों, बैराजों, तटबंधों, जलविद्युत परियोजनाओं, व्यापक वाणिज्यिक और अवैध रेत खनन, सीवेज और अपशिष्ट डंपिंग, इंटरलिंकिंग और रिवर फ्रंट परियोजनाओं के निरंतर निर्माण का विरोध करते हैं।' इनके कारण भूमि उपयोग और जल विज्ञान में परिवर्तन ने देश में सतही और अंतर-जुड़े भूजल दोनों व्यवस्थाओं पर संकट लाया है, जिससे लाखों लोग विस्थापित हुए हैं और उनकी अजिवका छिन गयी है।
हिमधरा पर्यावरण समूह की मंशी आशेर ने बताया कि कैसे पर्वतीय क्षेत्रों में बांधों और अन्य भारी अंधाधुन निर्माण परियोजनाओं के बढ़ते दबाव ने जलवायु संकट के प्रभावों से जूझ रहे हिमालयी क्षेत्र को आपदा ग्रस्त, विशेष रूप से बाढ़ क्षेत्र में बदल दिया है। 2023 एक बहुत खतरनाक साल साबित हुआ है। उन्होंने कहा कि ‘लद्दाख में चल रहा संघर्ष इसी पारिस्थितिक संकट की गंभीरता को उजागर कर रहा है’ वहीं कोसी नव निर्माण मंच, बिहार के महेंद्र यादव ने सीमा पार नदियों के कुप्रबंधन से जुड़े मुद्दों को आगे उजागर किया। उनका कहना था कि 'नदियों को नियंत्रित करने के लिए तटबांधों को झूठे समाधान के रूप में पेश किया गया है और यही बाढ़ का कारण बन गया है। तटवर्ती समुदायों को विस्थापन का सामना करना पड़ा है और यहां तक कि कोसी पीड़ित विकास प्राधिकरण जैसे तंत्र भी केवल कागजों में सीमट कर रहे गये हैं और कोई राहत या पुनर्वास प्रदान नहीं की जा रही।
बरगी और बसनिया बाँध संघर्ष, मध्य प्रदेश से राजकुमार सिन्हा ने शहरी प्रदूषण और नर्मदा और उसकी सहायक नदियों पर अवैध रेत खनन की दोहरी समस्याओं पर प्रकाश डाला। उन्होंने कहा, 'जब तक सार्वजनिक संवाद और शासन में भागीदारी नहीं होगी, हम इन सवालों का समाधान नहीं कर सकते हैं' और इस बात पर भी प्रकाश डाला कि जो आदिवासी अनुसूचित क्षेत्रों में जल भंडारों और जंगलों का अधिक संरक्षण करते हैं, उन्हीं को सबसे अधिक विकासात्मक नीतियों का खामियाजा भुगतना पड़ रहा है। मुल्लापेरियार के अनुभव से बोलते हुए, ऑल केरला रिवर प्रोटेक्शन काउंसिल के एसपी रवि ने 'उन राजनेताओं पर भरोसा करने की बजाय, जो केवल निहित स्वार्थों के लिए संघर्षों को बढ़ाते हैं, संघर्ष समाधान के लिए लोगों से लोगों के बीच बातचीत' की आवश्यकता जताई।
गुजरात स्थित पर्यावरण सुरक्षा समिति के क्रिनाकांत ने कहा, ‘ जैसा साबरमती नदी के रिवर फ्रंट प्रोजेक्ट पर उच्च न्यायालय की याचिका ने उजागर किया है – कि यदि हम नदी की प्रवृति और प्रवाह को समझे बिना अवैज्ञानिक तरीके से योजनायें बनाते हैं तो नदियों और इस पर निर्भर लोगों पर नकारात्मक प्रभाव निश्चित ही पड़ेंगे’. प्रेस वार्ता का संचालन गुजरात लोक समिति की मुदिता विद्रोही ने किया जिसने प्रशासनिक प्रबंधन के ढाँचे पर सवाल खड़े करते हुए कहा कि किस तरह इन जन विरोधी और प्रकृति विरोधी परियोजनाओं को लोगों पर बिना सुनवाई के लादा जाता है!
प्रस्तावित नदी संरक्षण कानून के मसौदे में संबोधित कुछ प्रमुख मुद्दे:
v जीवन के स्रोत के रूप में नदियों के समग्र महत्व की पहचान और नदी संरक्षण को प्राथमिकता देने वाले विकास प्रतिमानों की वकालत करना।
v अन्यायपूर्ण अतिक्रमणों (विशेषरूप से बांधों और तटबंधों) और नदियों पर पड़ने वाले प्रभावों को संबोधित करने के लिए मौजूदा कानूनों और संवैधानिक मूल्यों के साथ तालमेल बिठाना।
v नदियों को उनके जल प्रवाह के आधार पर परिभाषित करने से लेकर, नदी के पारिस्थितिक तंत्र की रक्षा करने और संसाधन आवंटन/साझाकरण में वितरणात्मक न्याय सुनिश्चित करने तक के सिद्धांत लागू करना।
v गैर-मानसूनी महीनों में भी नदियों को सूखने से बचाने के उपायों के साथ, प्राथमिकता के रूप में नदियों के निरंतर और अप्रदूषित प्रवाह पर जोर देना ।
v अवैध रेत खनन, शहरी, औद्योगिक और कृषि स्रोतों से होने वाले प्रदूषण पर सख्त नियंत्रण करके, नदी जलग्रहण क्षेत्रों में वनीकरण और वन आवरण की सुरक्षा का आह्वान करना/
v नदियों और उनके पारिस्थितिक तंत्रों पर विकास गतिविधियों के प्रभावों का व्यापक मूल्यांकन और रोकथाम, निर्णय लेने में तटवर्ती समुदायों के परामर्श और सहमति को सुनिश्चित करना।
v विस्थापन संबंधी चिंताओं का समाधान करना और प्रभावित आबादी के लिए उचित मुआवजे और पुनर्वास नीतियों की वकालत करना।
v विभिन्न विषयों की विशेषज्ञता और वैधानिक एजेंसियों, नागरिक समाज और नदी समुदायों के प्रतिनिधित्व के साथ एक नदी बेसिन प्राधिकरण(RBA)स्थापना।
v RBA परिभाषित कार्य, जिसमें नदी सुरक्षा और संरक्षण से संबंधित कार्यों की योजना बजट निष्पादन और निगरानी शामिल है।
v पारिस्थितिक और सामाजिक-सांस्कृतिक मूल्यांकन और सार्वजनिक परामर्श को शामिल करते हुए, अंतर-विषयक समितियों द्वारा प्रत्येक नदी के लिए मास्टर प्लान तैयार करना।
v इन समितियों की जिम्मेदारियों की रूपरेखा तैयार करें, जिसमें बजट तैयार करना, निष्पादन की निगरानी और निगरानी समितियों की नियुक्ति शामिल है।
v उल्लंघनों के खिलाफ़, कानूनी और प्रशासनिक कार्रवाई और अनुपालन सुनिश्चित करने के लिए, नियमित सर्वेक्षण और अनुसंधान का आह्वान।
नदी तटीय अधिकार और नदी संरक्षण व पुनर्जीवन पर यह ऑनलाईन प्रेस कान्फ्रेंश लोकतंत्र की रक्षा और संविधान को बचाने के लिए आगामी संसदीय चुनावों को देखते हुए आयोजित की गयी थी। कार्यकर्ताओं का कहना है कि पीपुल्स रिवर प्रोटेक्सन बिल को सभी राजनातिक दलों और उनके सांसदों को अपने-अपने चुनावी घोषणा पत्र में शामिल करने के लिए भेजा जा रहा है ताकि वह हमारी नदियों और नदियों पर बसे मसुदायों के सामने आ रहे गंभीर मुद्दों का संज्ञान ले सकें।
