Press Release: 80+ Lawyers & Law Researchers Petition Odisha Governor to halt proposed public hearings for bauxite mining amidst repression

MORE THAN EIGHTY LAWYERS PETITION THE GOVERNOR OF ODISHA TO HALT PROPOSED PUBLIC HEARINGS FOR PROPOSED BAUXITE MINE BY VEDANTA AMIDST ONGOING ARRESTS AND RAIDS ON AFFECTED COMMUNITIES IN RAYAGADA DISTRICT

More than 80 lawyers, including Advocates, legal academics and researchers, today wrote to the Governor of Odisha raising concerns about the alarming arrests and illegal detentions of about two dozen persons from Rayagada district in Odisha in anticipation of the upcoming public hearing for the Sijimali bauxite mine proposed by M/s Vedanta Ltd. The letter, endorsed by legal luminaries such as Prof. Kalpana Kannabiran, Gautam Bhatia, Prashant Bhushan, among others, calls for an immediate halt to the public hearings to clear 1549 hectares of forest lands lying in areas covered by the V Schedule of the Constitution for violating the right to free, prior and informed consent of the affected communities.
Instead of undertaking due consultations under the PESA and FRA, the letter points out, the state government has followed an approach of repression to secure clearances through coercive means. Since early August, the police and paramilitary forces have conducted midnight raids, illegal detentions and arrests against the people of Kashipur village. Nine leading activists of the Niyamgiri Surakshya Samiti, including Lada Sikaka, Drenju Sikaka, Lingaraj Azad and poet Lenin Kumar have also been made the subject of an FIR under the stringent Unlawful Activities (Prevention) Act (UAPA) for unlawful and terrorist activities. Goldman Environmental Prize 2017 winner, Prafulla Samantara was abducted with his face covered and hands tied, and driven from Rayagada to his hometown in August 2023. In addition, several FIRs have been filed by both the police as well as an official of M/s Mythri Ltd., related to M/s Vedanta Ltd., cumulatively naming about a hundred persons, along with hundreds of other unnamed. As such, kin of those arrested are struggling to secure their bail, while also looming under the threat of further persecution under these open-ended FIRs.
With key leaders in prison or facing further persecution, the state government insists proceeding with the public hearings, without complying with the legal requirements under the V Schedule, Panchayats (Extension to Scheduled Areas) Act (PESA), Forest Rights Act (FRA) and the EIA Notification 2006 on full-disclosure of information regarding the proposed project. Pertinently, the Letter of Intent for the project was approved only in March this year, and the clearance process is inexplicably proceeding at break-neck speed without due regard to the right of the affected communities to free, prior and informed consent. It bears noting that the bauxite mine is proposed over more than 1500 hectares of rainforests supporting large biodiversity, water bodies and local livelihoods, all of which stand to be affected in the absence of free, adequate and transparent environmental and social assessments.
The letter calls upon the Governor to release those imprisoned since August 2023 and withdraw all criminal proceedings, including those under the UAPA, to uphold their right to participate in consultations freely. The letter also calls upon the Governor to ensure that information about the proposed bauxite mine is duly made available in compliance with the law, and to further halt the public hearings until an atmosphere of free and open democratic participation can be ensured.

25 सितंबर 2023: 80 से अधिक वकीलों, कानूनी शिक्षाविदों और शोधकर्ताओं ने आज ओड़िशा के राज्यपाल को पत्र लिखकर वेदांता लिमिटेड द्वारा प्रस्तावित सिजीमाली बॉक्साइट खदान के लिए आगामी सार्वजनिक सुनवाई की प्रत्याशा में रायगडा जिले से लगभग २ दर्जन लोगों की अवैध गिरफ्तारियों और हिरासत के बारे में गंभीर चिंता जताई। यह सार्वजनिक सुनवाई संविधान की V अनुसूची के अंतर्गत के आने वाले 1549 हेक्टेयर क्षेत्र को खाली करने के लिए आयोजित की जा रही है | प्रोफ़ेसर कल्पना कन्नाबिरन, वरिष्ठ अधिवक्ता प्रशांत भूषण, गौतम भाटिया, जैसे कानूनी विशेषज्ञों ने इस पत्र में प्रभावित समुदायों की स्वतंत्र, पूर्व और सूचित सहमति के अधिकार का उल्लंघन करने के लिए राज्यपाल से सार्वजनिक सुनवाई को तत्काल रोकने की मांग की है। पत्र में बताया गया है कि पंचायत (अनुसूचित क्षेत्रों पर विस्तार) अधिनियम (पेसा), 1996 और वन अधिकार अधिनियम (एफआरए), 2006 के तहत उचित परामर्श करने के बजाय, राज्य सरकार ने मंजूरी हासिल करने के लिए जबरदस्ती का माध्यम और दमन का दृष्टिकोण अपनाया है।
अगस्त की शुरुआत से, पुलिस और अर्धसैनिक बलों ने काशीपुर गांव के लोगों के खिलाफ आधी रात को छापेमारी, अवैध हिरासत और गिरफ्तारियां की हैं । नियमगिरि सुरक्षा समिति के नौ प्रमुख कार्यकर्ताओं, जिनमें लाडा सिकाका, द्रेंजू सिकाका, लिंगराज आजाद और कवि लेनिन कुमार शामिल हैं, का भी नाम गैरकानूनी और आतंकवादी गतिविधियों के लिए सख्त गैरकानूनी गतिविधियां (रोकथाम) अधिनियम (यूएपीए) के तहत दाखिल एफआईआर में दर्ज किया गया है | अगस्त २०२३ में गोल्डमैन पर्यावरण पुरस्कार 2017 के विजेता, प्रफुल्ल सामंतरा का चेहरा ढंककर और हाथ बांधकर अपहरण करके उन्हें रायगड़ा से उनके गृहनगर ले जाया गया। इसके अलावा, पुलिस के साथ-साथ मेसर्स वेदांता लिमिटेड से संबंधित माइथ्री लिमिटेड के एक अधिकारी द्वारा भी कई एफआईआर दर्ज की गई है जिनमे कुल मिलाकर लगभग सौ व्यक्तियों के साथ-साथ सैकड़ों अन्य अज्ञात लोगों को नामित किया है। ऐसे में, गिरफ्तार किए गए लोगों के परिजन अपनी जमानत सुरक्षित करने के लिए संघर्ष कर रहे हैं, साथ ही इन खुली एफआईआर के तहत आगे उत्पीड़न का खतरा भी मंडरा रहा है।
जहाँ एक तरफ प्रमुख नेता जेल में हैं या उत्पीड़न का सामना कर रहे हैं, वहीँ राज्य सरकार सविंधान की पांचवीं अनुसूची, पंचायत (अनुसूचित क्षेत्रों पर विस्तार) अधिनियम, वन अधिकार अधिनियम और पर्यावरण प्रभाव आकलन अधिसूचना 2006 में दी गयी कानूनी आवश्यकताओं का अनुपालन किए बिना, सार्वजनिक सुनवाई पर जोर दे रही है। गौरतलब है की परियोजना के लिए आशय पत्र को इस साल मार्च में ही मंजूरी दे दी गई थी, और प्रभावित समुदायों के स्वतंत्र, पूर्व और सूचित सहमति के अधिकार की परवाह किए बिना मंजूरी प्रक्रिया बेवजह तीव्र गति से आगे बढ़ रही है। ध्यान देने योग्य बात यह है कि बॉक्साइट खदान 1500 हेक्टेयर से अधिक वर्षावनों में प्रस्तावित है जो बड़ी जैव विविधता, जल निकायों और स्थानीय आजीविका का जीवनाधार हैं।यह सभी स्वतंत्र, पर्याप्त और पारदर्शी पर्यावरणीय और सामाजिक मूल्यांकन के अभाव में गंभीर रूप से प्रभावित होंगे।
पत्र में राज्यपाल से अगस्त 2023 से जेल में बंद लोगों को रिहा करने और यूएपीए के तहत सभी आपराधिक कार्यवाही वापस लेने का आह्वान किया गया है, ताकि उनके स्वतंत्र रूप से परामर्श में भाग लेने के अधिकार को बरकरार रखा जा सके।पत्र में राज्यपाल से यह सुनिश्चित करने का भी आह्वान किया गया है कि प्रस्तावित बॉक्साइट खदान के बारे में सभी जानकारी कानून के अनुपालन में विधिवत उपलब्ध कराई जाए, और सार्वजनिक सुनवाई को तब तक रोक दिया जाए जब तक कि स्वतंत्र और खुली लोकतांत्रिक भागीदारी का माहौल सुनिश्चित न हो जाए।
