May 27, (THEWILL) – A Federal High Court, presided over by Justice Fatun Riman, has declared the appointment and continued stay in office of the Inspector-General of Police (IGP), Usman Alkali Baba, as illegal and unconstitutional.

Justice Riman ordered IGP Baba to stop parading himself as Nigeria’s Inspector General and directed President Muhammadu Buhari to convene a meeting of the Nigeria Police Council to appoint a new IGP.

The order followed, a suit marked FHC/AKW/CS/58/2023, and filed by Okechukwu Nwafor.

The Plaintiff had dragged President of the Federal Republic of Nigeria, Usman Alkali Baba, Attorney General of the Federation and Minister of Justice and Nigeria Police Council before the court, seeking an order to stop the IGP from further occupying office as his tenure has expired.

However, Justice Riman held that Alkali’s continued stay in Office negates the provisions of the Police Act, 2020.

“It is important to observe that the Inspector-General of police is a public servant and by virtue of the fact that he is a member of the staff of the Nigeria Police Force, an authority established from the Federation by Section 214 (1) of the Constitution and in the subject of the Federal Public Rules 299 (PSR) thereof which provides for the compulsory retirement of all grades of public service officers at the age of 60 or 35 years of service, whichever comes first.

“In the instant case, the 2nd Defendant’s (IGP’s) birthday comes first. By the said Rule, the 2nd Defendant is obliged to step down on March 1st 2023. The PSR retirement age provision, is mirrored in section 18 (8) of the Police Act, on the word “Shall” is used in the provision, it is mandatory. See the case of ISHOLA V. AJIBOLA 1994 4 NWLR PT 352 para 506 by Rhodes Vivour JCA (as he then was) and also IBRAHIM & ANOR V. AKINRISOLA (2010) LEPLR 444 CA, Section 7 (6) at the Police Act provides for a four-year term or tenure for the Inspector General of Police and the word “Shall” is also used in the said provision.

“I also observe that despite the prerogative power of the President, he is limited to the provisions of the Constitution. The Inspector General of Police retirement is a statutory and constitutional issue and no other law of the land can change the ground norm”, the court ruled.

Excellent decision! I knew that the court would so rule if it followed the law because retirement age, that is enshrined in the Constitution, takes precedence over the tenure law of the IGP's. Besides, the law on tenure does not cover any IGP who could be 60 years of before he/she sits on the post for 4 years, those who allowed this man or woman (he looks more like a woman than a man) obviously flouted the Constitution. President Buhari got away with unconstitutionally retaining Buratai and other Service Chiefs for multiple years after they should have retired but I am gad that someone sued and had this foolishness stopped. 

Four-year tenure for IGP applies to IGPs who wouldn't reach retirement age within fours years from when appointed, period. It was criminal to have used that new law to circumvent the constitutional requirement of police officers to retire at age 60 or after 35 years in office. This brilliant decision notwithstanding, I do not believe that the election tribunals and the courts would vacate Tinubu's selection as president -- Nigeria is not that sophisticated. If you want to defeat a heavyweight boxing champion, knock him out because anything can happen if it goes to the judges. Not stopping Tinubu on February 25th means APC would be in for the next 4 years at least -- I have no confidence in the judiciary over this election.

If that was how the courts work, I would’ve been jubilating for the three judgements handed out against enemies of Tinubu with heavy fines.

Atiku’s aide congratulates Tinubu, Shettima after taking oath of office as President, Vice

Daniel Bwala, an aide to the 2023 presidential candidate of the Peoples Democratic Party, PDP, Atiku Abubakar, has congratulated President Bola Tinubu and his Vice, Kashim Shettima for taking their oath of office.

Tinubu and Shettima took the oath of office under the guidance of the Chief Justice of Nigeria, Justice Olukayode Ariwoola, at Eagles Square in Abuja.

During his swearing-in, Tinubu vowed to be faithful and bear true allegiance to the constitution of Nigeria.

This comes after he defeated Atiku, the Labour Party, LP, presidential candidate Peter Obi, and Rabiu Kwankwaso of the New Nigeria People’s Party, NNPP.

Despite his emergence, Atiku and Obi are contesting his victory at the election tribunal.

They argued that the election that made Tinubu president was flawed and marred with electoral malpractice.

However, Bwala tweeted: “May I congratulate Bola Ahmed Tinubu @officialABAT and Kashim Shetima @KashimSM for taking the oath of office and allegiance as the 16th President and Vice President of the Federal Republic of Nigeria to defend the constitution and administer the Federal Republic of Nigeria.

The airports include Akure International Airport named after Olumuyiwa Bernard Aliu; Benin International Airport now known as Oba Akinzua II; Dutse International Airport renamed Muhammed Nuhu Sanusi; Ebonyi International Airport Okadigbo now known as Chuba Wilberforce; and Gombe International Airport renamed Brigadier Zakari Maimalari.

The president of Nigeria is not an autocrat, he is checked by the legislature and judiciary. When the president violates the Constitution, he can be checked by the judiciary and legislature. The judiciary his done its checking in this case, were Buhari still in office and the legislature felt like impeaching him, it could do so over this brazen violation of the Constitution. What’s your take on the administration of Tinubu removing the oil subsidy?he said so in a speech. How will such a move affect the everyday Nigerian and the Nigerian people economy? 

I like the idea because the oil subsidy thing has always favored the rich way more than the poor than it was meant to favor.

Tinubu is lucky to have Dangote's new refinery completed and opened when he became president, otherwise he would face hell and backlash on the economy. Subsidy removal is not an easy thing to initiate in an economy with high inflation and high unemployment like Nigeria's. That's the reason why both Jonathan and Buhari dodged it. Fortunately for Tinubu, Dangote's refinery has come online. A lot of oil refined abroad will now be refined in Nigeria, so oil prices will be reduced as time goes on and wouldn't affect Nigerians and the economy that much. More so, Dangote's refinery will save Nigeria foreign exchange. Nigerians will gain tremendously with Dangote's refinery.

The downside of it is that, Nigerians being the type of people they are will like to create artificial scarcity of Petroleum in order to raise prices, which will have adverse effects on goods and services. Marketers will be hoarding oil, unless Tinubu rein down on them as quickly as possible.

Tinubu is not smart at it. If I were him, I wouldn't announce the removal of subsidy till six months after Dangote's refinery commences operation. He doesn't have good advisers. He should have waited for six months before doing it. Prices of things will go up due to artificial scarcity the oil marketers will create. It's not a smart move at all.

Dangote refinery will have little impact on the pricing of fuel.

Dangote refinery will buy crude at the going international crude rate. If Dangote is given a concession to buy at a lower rate, them that will be another form of subsidy.

Kayode is right about the foreign exchange savings that Nigeria will make as the country will not be importing anymore. However, the only reduction in pricing that will be passed on to the masses is the savings on freighting of imported petroleum products. With Warri, PH and Kaduna refineries scheduled to come back on stream in the next year or so, Nigeria will have spare capacity that make the market more competitive.

Subsidy of fuel has always been a bad policy. No sane government subsidize consumption. Subsidy of production, yes, but subsidy of consumption is a waste of resources.
For example, here in the UK, diesel is subsidized, but only for farm production and even the farmer cannot use the diesel to do town runs in their private cars as the diesel gives a distinct coloured exhaust that law enforcement officers will recognize immediately as subsidized diesel.

You are correct when you wrote that it will have little impact on pricing of fuel for the reason (price of crude oil) you stated. Baba Kayode is right in regard to the timing with Dangote refinery going online and because he correctly stated that we will spend less of our forex The move will not reduce the price of gas in Nigeria - if any, it would be very little.

I read Tinubu’s broadcast in its entirety, you dummy who has no knowledge of Economics called Nebukadimonkey Adiele. You don't announce subsidy withdrawal on Day One of your administration without knowing there would be consequences, repercussions and backlash. That would create Hyperinflation in Nigeria. Tinubu is a shroud politician without knowing anything about Economics. Annoucing the subsidy withdrawal before any mitigation is like putting the cart before the horse. He supposed to ensure Dangote's refinery has started production and its products have reached market for at least 6 months, before making such announcement. Furthermore, it supposed to be gradual. It will also bring the needed foreign exchange and revalue the Naira, because it will be refining oil for other countries too. What Tinubu should have done is create a supplementary budget that would support subsidy for six months, while preparing for the withdrawal of subsidy in six months. Unfortunately, he didn't think before he acted and now prices of gasoline have tripled within 24 hours and prices of foodstuffs, products and services have equally gone up with 24 hours of his announcement like I said they would yesterday and he is now telling Nigerians that the withdrawal will not take immediate effect. That's too late to mend. He already did the damage. Tinubu is not a smart administrator.

Tinubu dared the out-gong administration to deny his charge and also informed everyone that the Buhari regime removed the money for fuel subsidy on the eve of its departure in the budget they left for him to begin his administration -- Tinubu was actually telling the world that he is not reckless enough to remove fuel subsidy without putting XYZ in place but that removing it has been forced on him by his predecessor who secretly removed it effective June 1st. 

Even though I didn't want Tinubu to be the president of the country of my birth, because of his corrupt/nepotistic ways and his seeming ill-health, I have admired his political gutsiness since he was the governor of Lagos state, when he took on the Dracula that was president Olusegun Obasanjo. I also observed him (I was visiting Nigeria then) take on the Northern oligarchy, who thought that they were still in charge of Nigeria while Obasanjo was president, by openly chastising them for instigating the almajirai into rioting in Lagos. Despite his corrupt, nepotic, and criminal ways, I think that Tinubu's comment on fuel subsidy removal was excellent in every material particular -- he was truthful to Nigerians and to the international community in real time as to how fuel subsidy ceased in Nigeria. He might win me over if he runs his administration as transparently as he handled the subsidy announcement. 

Nigerians say, "cunny man die, cunny man bury am". The Buhari regime was being cunny and setting up of the Tinubu regime for trouble in removing fuel subsidy clandestinely. However,  Tinubu turned the table on them by informing everyone who might be interested in fuel subsidy that Buhari cowardly and mischievously removed it just two days to leaving office. That is a masterpiece of a political chess playing on day one, an A+ for Tinubu on his first day in office. Unfortunately, dumb asses like Deranged Ape Kayode Adebammuọjọ could never and can never get it; they'd rather utter idiocy while pretending to be supporters of Tinubu and analyzing political/economic events of the new regime.

Tinubu did not remove the oil subsidy, Incompetent Buhari did it two days to his leaving office.
I told people here that Buhari’s side of the APC doesn’t want Tinubu to win, so rigging for Tinubu was just figments of Igbo’s imagination.
Buhari has done all he could to wreck the ship for Tinubu, he’s a two-headed snake that only a Yoruba can outmaneuvered.
In a few days we will hear about more rotten things he had done, like the Nigeria Air farce he pulled recently, and the Emefiele new currency scandal.
Emefiele couldn’t have pulled those disastrous stunts without Buhari’s approval.

Anyway, I didn't know that the Buhari regime had announced that it would let fuel subsid phase out in June when it knew that it would be out of office two days later. I don not believe that Tinubu would agree to that since it could damage his administration before it even started. After 8 years, Buhari should have left the subsidy matter entirely to his successor to handle the way he feels fit. Tinubu had to let everyone know that, even though he promised removal of fuel subsidy, he did not recklessly do so upon assuming office, it was forced on him by his predecessor's budget. 

I now believe that Buhari actually didn't want Tinubu to succeed him, or if he did, some advisers undermined that by letting him into taking actions that would undermine Tinubu.

Anyway, I didn't know that the Buhari regime had announced that it would let fuel subsid phase out in June when it knew that it would be out of office two days later. I don not believe that Tinubu would agree to that since it could damage his administration before it even started. After 8 years, Buhari should have left the subsidy matter entirely to his successor to handle the way he feels fit. Tinubu had to let everyone know that, eve though he promised removal of fuel subsidy, he did not recklessly do so upon assuming office, it was forced on him by his predecessor's budget. 

I now believe that Buhari actually didn't want Tinubu to succeed him, or if he did, some advisers undermined that by letting him into taking actions that would undermine Tinubu.

Buhari Administration ended on May 29, while Tinubu, his successor's administration started May 29. Buhari did not force anything on Tinubu. He made the subsidy up till June to allow his successor to decide if he wants to continue with the subsidy regime or end it. Each administration has its own decision to make. Tinubu can not pass any blame on Buhari. It was not Buhari’s responsibility to extend the subsidy beyond his term. That responsibility rests on Tinubu who ignorantly didn't anticipate the impact and backlash of the withdrawal. A litre of gasoline is now selling for N500 and it took the shuting down of gas stations and increase prices of gasoline, products, commodities and services to make him realize the grave mistake he made and had to hold emergency meeting with the CBN Governor and others last night to decide on what next to do to correct his mistake. He should have waited till he assumes office yesterday to make a decision, not at the swearing-in ceremony. That was very dumb. He pushed the cart before the horse.

I advised the Buhari Administration not to remove the subsidy, because I knew the impact it would have on the economy and the people of Nigeria and I'm glad he listened till the last day.

All Tinubu needed do was wait for six months to allow Dangote's refinery to start producing and for the products to reach the market. Tinubu is lucky to have Dangote. He would benefit a lot from that refinery like I said and the economy will grow tremendously during his administration, because of the refinery. The foreign reserves will also grow big time and there will a lot of foreign exchange. The Naira will also appreciate. Buhari didn't have that luck.

Unfortunately, you are an empty head. Go to school and study Economics and stop disgracing yourself on the internet.
