Your dumb lawyer didn't know what he was talking about. There are two cases before the High Court and both cases were filled by the two different factions of ADC. Furthermore, both cases are scheduled for April 13 and April 14 respectively.

In addition, your dumb lawyer didn't know that Gombe was the Deputy National Chairman to Nwosu. Obviously, he was just talking about what he didn't know anything about.

He was talking about INEC attending the sham election that produced Mark and Rauf Aregbesola. The question before the court is that Mark and Rauf Aregbesola are not officials of ADC. They hijacked the party. The election that brought them as executive members did not follow the party’s constitution. So, its null and void. The fact that INEC attended their sham election amounts to nothing, because INEC was not aware that they hijacked the party by bribing Nwosu to step down. They just invited INEC and INEC honored their invitation. As such, INEC's attendance is immaterial to the case.

I think we are getting ahead of ourselves.
1. David Mark lawyers are stupid fools.Fact!
2. The lawyer wasted unnecessary time appealing what was not a verdict by the federal high court.
3. The federal high court refused to grant ex-parte ruling on the request to make Mark interim chairmanship illegal. He only directed that the other parties should be put on notice which was very reasonable.
4. The appeal court was right to strike out the appeal on the grounds of no competence because there was no ruling beeong appealed against.
5. The federal high court judge had shown fairness by notifying and requesting that the other party is informed of the ex-parte filing. He could have granted the prayers under the ex-parte hearing to which appeal to the court of appeal would have been appropriate.

6. I don't know much about the second filing and court case, the Bala one is what above is all about.

So, when people like ADC chieftains, Chukwuemeka Okala and their ilk are seeing Tinubu's hand in everything, they all need to be introspective and blame their incompetent legal representation.

The Electoral Act of 2026 that your lawyers and the Nigerian Bar Association was referring to was signed into law by Tinubu on February 19, 2026 and Nafiu Bala Gombe had instituted a legal action against the hijackers called David Mark and Rauf Aregbesola in 2025, long before the new Electoral Act came into being. Nafiu's law suit against the the hijackers susbsists, and must be seen into conclusion by the court. It cannot be abandoned by the court. 

Your lawyers and the NBA are ignorant of Nigeria's laws. They all need to go back to Law School. In Law, a bill becomes law only and only if, and when it's signed into law by the President of the Federal Republic of Nigeria. They all failed law woefully.

They are a shame and an utter disgrace to the Nigerian Bar.

APC is using the courts to setting up ADC for disqualification from fielding candidates in the next election, what is going on is not a real court process, this is Ihediọha 2.0.  The court of Appeal had no jurisdiction to asking both parties to maintain the status quo ante bellum in a case it dismissed for having no standing to have been filed in the first place. 

Recall that the case in question was David's Mark's nosy case against the federal high court that is sitting on the case filed by Gombe Nafiu Baba or whatever his name is. That federal high court refused to give a summary judgment against ADC, so the judge asked Gombe to serve the court papers to ADC et al. David Mark, who was not a party to the lawsuit, stupidly appealed the decision -- he needed a special permission from the court to file that appeal since he was not a party to the case. The court of appeal rightly dismissed his appeal because it was meritless, but it gratuitously asked both parties to maintain the status quo ante bellum. The court had no power to have issued that order since the case before it was an invalid one -- it would have had jurisdiction over Gombe, ADC, et al had it had a valid case before it.

My point: As was the case with Uzọdimma v Ihediọha, APC are going to use these groundless legal obstacles they are setting to doing-in ADC at the last minute. Ihediọha and his lawyers -- and almost every sound lawyer in Nigeria -- thought that Uzọdimma and APC were jokers when they were moving to the Supreme Court with that ridiculous case. If the opposition has not learned its lesson from that incident, then they would not be pitied for whatever happens to them next.

I am not sure that this information is up to date, this video doesn't convey any update relevance -- see my previous response. David Mark had no standing to filing his appeal and it was soundingly thrown out. 

If this lawyer is talking about a different case, the plaintiff should be ADC, not David Mark, unless it is a fresh case filed by Mark against Gombe. Make una no let APC deceive una and catch una unawares o, as they caught Ihediọha.

The federal court in Bala's ex-parte law suit did not give a verdict. It gave a direction that the parties should be served notice to defend themselves on fairness.
The verdict by the appeal court rightly struck out the case as incompetent and awarded cost against David Mark for filing appeal where no judgement or verdict has been passed by the trial court.
The appeal court was very much in it's right to state that all parties should maintain "status quo ante bellum" or whatever (I'm still unsure why courts use Latin terms while perfect English translation exist)..

Nebu, fold your tent and crawl back under a rock where your type dwell and survive.

Court of Appeal is an appeal court with jurisdiction to hear appeals from parties to a case, you dummy who needs to go to school and get educated. You don't appeal a case that's pending determination in a lower court. If you studied law, you would have known that.

For your education, David Mark and Rauf Aregbesola jumped the gun by going to the Court of Appeal to appeal a case that's was pending judgment at the high court. That's why the Court of Appeal dismissed the case with penalties to both David Mark and Rauf Aregbesola and asked the parties to the case to maintain status quo ante bellum, meaning they should go back in time to the leadership state before the dispute erupted in the ADC, meaning the ADC original owners executive council.

Google is not a University or Law School you Googler called Nebukadimonkey Adiele. If you had studied law in college you would have been taught that if a case is filed before an appeals court, it has the power to rule on it by either hearing the case or dismissing the case if it has no merit and has the power to ask the parties to maintain status quo.

The above is my position on David Mark's lawsuit and the Court of Appeal, it is consistent with the positions of the two dullards and moronic savages of Femi Olajide and Kayode Adebammuọjọ, who I have been informed, are abusing me on the forums because they stupidly did not comprehend what I wrote (I went to the archive/website to read their idiotic utterances after I was informed of their foolishness). The only difference between my opinion and theirs, on this particular aspect of the case, is my saying that the Court of Appeal had no jurisdiction to have issued the maintain status quo ante bellum order. If this duo was educated or knew anything about the law, they would have known that not even the Supreme Court has the power to issuing an order on a case before a lower court, especially when it just dismissed Mark's appeal of that particular case for having no merit -- had the case merit and continued, the Appeal Court would have had jurisdiction to saying what it said. These morons, because they are not lawyers but are dumb asses, do not know that the Appeal Court's jurisdiction over Mark, ADC, and Gombe ended the moment it determined that Mark's appeal lacked merit and dismissed it -- no court has the power to issuing order over anybody or any entity over whom/which it has no jurisdiction. 

Since the case at the high court could return to it on appeal later, the Appeal Court was expected to not add anything from merely dismissing Mark's appeal. Just because it is the Court of Appeal doesn't mean that it must not follow the rules that govern judicial processes. This order that it issued on a case in an inferior court will disqualify it (the judges who sat on this panel) from hearing future appeals arising from this case -- they have needlessly injected bias or incompetence in the case with that order. 

Dealing with assholes like Femi Olajide and Kayode Adebammuọjọ is one of the downsides to belonging to these forums that are gradually dying; their stupidity, semi-literacy, and rudeness are reasons why I blocked them, such that I don't see their dumb utterances. The same thing applies to the Supreme Court, the highest court in the land. If you had gone to school to study law, you would have known that.

(II) Once an appellate court dismissed an appeal for lacking merit, it immediately lost jurisdiction (power/right to hearing that case or power over the parties involved in the case). The Court of Appeal lost its jurisdiction (power/authority) to hearing the case and issuing orders over it the moment it dismissed it -- you sick moron who doesn't even know the encompassing meaning of jurisdiction, you only know the part you googled.

Further, it is not true that the Court of Appeal dismissed the case because David Mark jumped the gun and appealed a subsisting case (if you were a lawyer, you would have known that subsisting cases can be appealed if any of the parties disagreed with any major decision of the sitting judge). The case was dismissed because David Mark was not a party to Gombe's case, yet he appealed a decision of the court's. Mark's appeal was to the effect that the lower court has no jurisdiction to entertain the matter in light of the the Supreme Court having, on multiple instances, ruled that internal matters of political parties ought not to be resolved in courts (his contention is that judge Nwite should have dismissed Gombe's case). Were David Mark a party to Gombe's case, the Court of Appeal would have entertained and likely agreed with his appeal -- if the courts were not playing politics.

The case can still be appealed back to the appeal court by any party to the case in the future, after the lower court is done with it, you stark illiterate who needs law education. The appeal court dismissed the case for lack of merit and because Mark jumped the gun. The case is at the high court and will be heard or determined tomorrow April 14. 

As a matter of fact two of the cases brought against Mark will be heard tomorrow: Gombe’s case and the parliamentarian from Kongi's case. Furthermore, the case will be heard by the Supreme Court the same tomorrow. The lower courts might step down for the Supreme Court tomorrow, to avoid contradictory judgments.

Go to school and study Law and stop disgracing yourself on the internet.
