1) The claim that DDI will add reporters as defendants has no legal
plausibility, for the following reasons:
a. Clifford Shoemaker was sanctioned merely for tying to subpoena a
third-party reporter.
b. Journalists are substantially protected by “shield” laws.
c. Reports which were published after a suit was filed are clearly
irrelevant to any claims made in the original suit.
d. The activities for which Bolen claims reporters can be added as
defendants- reporting critically about DDI's suit, encouraging others
to write about the case, linking to each other's writings, allegedly
acting as a “network” and allegedly using “search engine optimization”
services- are in fact protected by any reasonable definition as free
speech, freedom of association, and free enterprise.

2) Throughout the course of “reporting” on the case, Bolen has claimed
to be a “crisis management specialist”, to be an “expert in the
politics of health care in North America “, and claimed to do business
as such through JuriMed Public Relations Group. In fact, he has no
apparent credentials in areas of public relations, medicine, politics
or law, and his business was officially delicensed by September,
likely after a long period without customers or significant revenue.

3) By claiming that reporters will be added as defendants by DDI,
Bolen has attempted to silence them and devalue their businesses and
property, ie websites, while making himself the sole source of
information and increase the value of his business and property, ie
website, thus attempting the “obtaining of property from another,
induced by a wrongful use of force or fear...”, defined as extortion
by California Penal Code 518.

4) By making the unsubstantiated claim that he was an “expert in the
politics of health care”, while claiming that reporters would be added
as defendants Bolen implied possible qualifications in law, Bolen
attempted to create a false “ color of official right” as described in
California Penal Code 518.

5) By claiming to have been told by an attorney that DDI can, should
and will add reporters as defendants, Bolen attempted to create a
false “ color of official right” as described in California Penal Code
518.

6) By claiming or implying that he is in a position to influence DDI
and counsel into adding reporters as defendants, Bolen attempted to
create a false “ color of official right” as described in California
Penal Code 518.

7) By falsely claiming that Jurimed was an active business, Bolen
implied that he might have been hired by and thus directly speaking
for DDI, and thus attempted to create a false “ color of official
right” as described in California Penal Code 518.

8) By claiming he can and will advise DDI and counsel to add reporters
as defendants, Bolen made “a threat to do an unlawful injury to the
person or property of the individual threatened”, defined as “fear”
under California Penal Code 519.

9) By claiming that reporters are members of a “civil conspiracy”,
Bolen “accuse(d) the individual(s) threatened... of (a) crime”,
defined as “fear” under California Penal code 519.

10) By claiming he can and will advise DDI and counsel to add
reporters as defendants, Bolen threatened “ to expose (and) to impute
to him or them... (a) disgrace or crime”, both defined as “fear” under
California Penal Code 519.

11) By making the unsubstantiated claim that he was an “expert in the
politics of health care”, while claiming that reporters would be added
as defendants Bolen implied possible qualifications in law, and thus
attempted “ extortion under color of official right” under California
Penal Code 521.

12) By claiming to have been told by an attorney that DDI can, should
and will add reporters as defendants, Bolen attempted “ extortion
under color of official right” under California Penal Code 521.

13) By claiming or implying that he is in a position to influence DDI
and counsel into adding reporters as defendants, Bolen attempted “
extortion under color of official right” under California Penal Code
521.

14) By falsely claiming that Jurimed was an active business, Bolen
implied that he might have been hired by and thus directly speaking
for DDI, and thus attempted “ extortion under color of official right”
under California Penal Code 521.

15) By claiming that reporters will be added as defendants by DDI,
Bolen has attempted to silence them and devalue their businesses and
property, ie websites, while making himself the sole source of
information and increase the value of his business and property, ie
website, indicating “ intent to obtain from another person any money,
article of personal property or other thing of value” under California
Penal Code 526.

16) On each occasion when Bolen has claimed to have knowledge that DDI
will add reporters as defendants, Bolen has “ delivered to the other
person (a) document... designed or calculated by its writing, typing
or printing, or the arrangement thereof, to cause or lead the other
person to believe it to be an order or other process of a court”,
defined as simulating legal process under California Penal Code 526.

17) By making the unsubstantiated claim that he was an “expert in the
politics of health care”, while claiming that reporters would be added
as defendants Bolen implied possible qualifications in law, and thus
attempted to “to cause or lead any person to believe” that his claim/
threat that reporters would be added as defendants represented a
possible “order or other process of a court”, thus simulating legal
process under Californa Penal Code 526 and 527.

18) By claiming to have been told by an attorney that DDI can, should
and will add reporters as defendants, Bolen attempted to “to cause or
lead any person to believe... that it will be used as an order or
other process of a court” under California Penal Code 527.

19) By claiming or implying that he is in a position to influence DDI
and counsel into adding reporters as defendants, Bolen has attempted
“to cause or lead any person to believe... that it will be used as an
order or other process of a court”under California Penal Code 527.

20) By falsely claiming that Jurimed was an active business, Bolen
implied that he might have been hired by and thus directly speaking
for DDI, and thus attempted “to cause or lead any person to believe...
