For the first time, here is a complete chronology of statements by Tim
Bolen and/or others threatening critics of DDI v. Barrett with being
made defendants, which DDI, Jeffrey Levens and
godaddy.com continue to
REFUSE to stop Bolen from making:
July 2,
bolenreport.com:
“I think that the Consumer Health Digest email list is definitely
worth subpoenaing. Why? Because it is there, I think you will find
a list of Barrett's ratty little helpers - those, in essence, named in
section (9) Civil Conspiracy, of the lawsuit. And THAT is where the
real fun will begin.”
July 4,
bolenreport.com:
“(S)ince Stephen Barrett was sued by Doctor's Data on June 18th,
2010, that he was served with papers on the 19th, the next day.
Counting 21 days from that moment brings us to Monday, July 12th, 2010
- the deadline for Barrett to hire an attorney who can practice in
Federal Court in Chicago, Illinois, and prepare, and submit a Response
to the Court. That's eight days from now - and Barrett does not even
have an attorney yet... If Barrett does not Respond then Doctor's Data
simply files for what is called a "Default Judgment," asking the Court
to award everything they asked for - the Five Million in Damages, the
Fifteen Million in Punitive Damages, and a permanent Injunction
barring Barrett from talking about Doctor's Data, etc.The Judge's
answer is almost automatic..Once the Judge issues the Default Judgment
and the Permanent Injunction Doctor's Data, through their attorneys,
will go into the "Judgment Collection" phase, using an attorney firm
that specializes in draining blood out of reluctant Defendants.”
July 6- ,
scienceblogs.com/insolence:
“Doctor's Data is probably going to buy the $112,000 plus interest
Court Judgment against the NCAHF who owes six homeopathic
manufacturers for attorneys fees. That would give Doctor's Data
immediate access to Barrett's financial records without having to wait
for Discovery in this new case. Then they could start the process of
seizing any money they find including contributions for his legal
fund. Judgments last forever and are unstoppable.... Doctor's Data is
going to seize Barrett's telephone and email records. That means that
they will then find reason to add many of you on as Defendants in the
case... Doctor's Data will be looking carefully for evidence of any
criminal act. If they find any they will be able to roll the Civil
Conspiracy Count into a full-blown RICO charge... Doctor's Data will
no doubt drag every one of you that mouth-off into the case as
Defendants. Don't think that a pseudonym will protect you. They will
find you. “
July 9:
Bolen reposts as his own this statement made at “Respectful
Insolence”, and also personally threatened the site administrator
simply for encouraging protests agains the suit: “Besides the fact
that "Orac" whined, like a girl, through the entire article, his
comments, it looks to me, are more than enough to get him added on as
a Defendant in the case. I can see that coming. But better, and this
where I give him the `dumb of the dumbest' rating, was his last
paragraph saying: ADDENDUM: You can help Dr. Barrett, too. If you're a
blogger, please write about this.
What "Orac" was doing was soliciting MALICE - and he was successful.
The kiss-ups went to work organizing what's called a "Googlebomb"
insuring that their totally libelous version of Doctor's Data, and
their version alone, dominated the internet search engines.”
ca. July 13, twitter:
“@lizditz Cease and desist libelling us or we will sue you.
http://tinyurl.com/docsdata. Doctor's Data Lawyers.”
July 16,
bolenreport.com:
In additon to falsely claiming that Barrett had already lost, Bolen
threatened, “There is, however, a high activity level from the
quackpot Farm Team. They are all over the place, whining, whimpering,
postulating, pontificating, pimpering, and mini-screeching - hoping
against hope that none of this is real and that it will all go away...
We can use this situation to shut them down completely. Forever... "
July 27,
gaia-health.com comment:
“Did this David Brown, who appears to be about sixteen years old, ever
give you an indication where he might have parked his "nine pages?" I
will be glad to pass his "published" statements on to Doctor's Data's
legal team so that they can "discuss" his statements in a more
structured environment - like a Summons after a "Second Amended
Complaint..."
ca. August 24,
examiner.com complaint:
““This article may get you a lawsuit!! Stephen Barrett and Quackwatch
are not a normal non-profit but work in suing people. Stephen Barrett
has sued over 100 people. He is an ex psychiatrist who was fired from
a mental hospital. Please remove this objectionable content. Google
Tim Bolen if you want to learn more.”
August 25,
bolenreport.com:
“Now, all it is going to get is that the blog owners and writers
involved will simply be added on to the lawsuit in a `Second Amended
Complaint.' My guess is that Doctor's Data's law firm, Augustine,
Kern, and Levens, is quietly sitting there like a cat outside of a
mouse hole. A pleasant, playful lunch will be along in a minute. It
will be a shock, I think, for individual members of the quackpot Farm
Team (the bloggers, and the commenters on those blogs) to realize that
after that guy that showed up at their place of work this morning,
with the Court Summons, they now have 21 days, themselves, to lawyer
up (mortgaging the house, selling the car, pawning the dog's jewelry),
individually, and Respond.”
August 27,
bolenreport.com:
“Instead of lawyering up and Responding, Barrett, and his minions,
went all out to completely destroy Doctor's Data during that period.
They increased the defamatory attack fifty-fold, virtually dominating
the internet... My prediction? Start thinking "Second Amended
Complaint" with quite a few new Defendants.”
August 31,
bolenreport.com:
“I could, on a few hours notice, provide Doctor's Data with a good
sized list of names that should be added to the lawsuit, along with
the evidence of the reason to add them. That, with a report from an
SEO expert attached, could shove the 2010 quackbuster operation up
against the wall with a "blindfold, no blindfold," choice to make.”
September 8, private email:
“Your so-called network is hiding under the bed right now - hoping
against all hope that Doctor's Data doesn't add them, individually,
onto the Chicago lawsuit... But since you seem to want to come out and
play with the big kids I am going to give you a piece of information
no one else on the quackbuster nutcase
side has yet. You can be a hero and pass it on to the rest - if you
dare. Why do I say "if you dare?" Because the information I am about
to give you will intimidate you and your associates very much, and
you, David Brown, seem to be concerned that I, Tim Bolen, am giving
you intimidating information...” (Bolen proceeded to make a clearly
false claim that charges against Jesus Caquias by the Texas Medical
Board had been filed by Barrett, and were being dismissed.)
September 9,
bolenreport.com:
“I recommend that Doctor's Data add on some more Defendants first - I
have a list of recommendations, some of which very clearly have "deep
pockets." I'll tell you about them, specifically, soon.”
September 12,
bolenreport.com:
“I think Terry Polevoy may be carrying out his threat to name the
people behind Barrett, and explain to someone exactly how the whole
quackbuster operation works - including who REALLY runs it - and it is
NOT Stephen Barrett. I'd almost bet that the attorneys for Doctor's
Data have a long, detailed Affidavit from Polevoy they can use to
magnify Count Nine (Civil Conspiracy) in the Doctor's Data v Barrett,
Federal Court case.”
September 22,
bolenreport.com:
“(T)hey are, and were, so arrogant about it that after the Doctor's
Data case was filed they used their power to try to openly (they
identified themselves) completely destroy Doctor's Data - and their
malicious activity in this operation is completely actionable. Every
one of them can, and probably will be, added as a Defendant in the
case in a future `Amended Complaint'. Is that a good thing to add on
new Defendants? Yes, it is - for two reasons. The first is that
Doctor's Data can wrap up Barrett's network in one simple action. And
the second is that several of the potential Defendants have some net
worth that can be used to pay damages. Liz Ditz, for instance, the
person who organized the "Googlebomb" has horses, and horse property,
in a very expensive area of Northern California. The house next door
to her, there, is currently for sale at a discount, for four million
dollars. Orac the Nipple Ripper (David Gorski) apparently writes his
blog from his desk at the Cancer Center (deep pockets) in Detroit
where he works. And more... The real beauty of the case is in what
happened AFTER the case was filed and Barrett's minions reacted with
what is known on the internet, as a "Googlebomb," increasing, with
Intentional Malice, the damage done to Doctor's Data, taking control
of the internet search engines on the subject. These fools actually
bragged that they, in full and open conspiracy, were going to create
much greater defamation... More, the Discovery in the case is going to
be a gold mine. When I say that I think this case will head towards a
RICO Complaint I am not exaggerating one bit - Civil AND Criminal. “
Oct. 10,
bolenreport.com:
“the same people that organized and participated in the Googlebomb,
provide the mechanism, in conspiracy, to facilitate Barrett's position
on Google, and the other search engines... Not often is a complete
conspiracy so quickly uncovered as has happened here in this case.
Usually conspirators keep their mouths shut and try to pretend that
there is no conspiracy. These people, in the their unbridled
arrogance, openly activated the conspiracy network, specifically, and
with gusto, to damage, intimidate, and completely destroy, with
further defamation, using Intentional Malice, not only Doctor's Data,
but the attorney firm representing them... They openly Googlebombed.
They took over the first three to four pages of Google and the other
search engines so that anyone, including the media, police
investigators, and the general public would get the false impression
that Doctor's Data and the doctors they served were criminals. That
action was, of course, not only Intentional Malice but Fraud, and a
conspiracy to defraud...I have instant access to some of the best
legal minds in the US. And I don't hesitate to call them. One of
them suggested this:
(1) The use of a regular Preliminary Injunction strategy to force
Barrett to take down his nonsense.
(2) The use of a `Gang Injunction' strategy to force all of Barrett's
minions to stop maliciously damaging Doctor's Data and the patients
and health professionals they serve.
Click on the words "Gang Injunction" and read some interesting legal
tactics. Think for a moment about the similarities between street
gangs and Barrett's support network. My guess is that since a Second
Amended Complaint was filed just as a document language cleanup, there
will probably be a Third Amended Complaint adding on more Defendants
and Counts.
And I don't think a RICO Complaint too far off, either.”
October 22,
bolenreport.com:
“Those accused in the lawsuit of acting conspiratorially will also be
forced to provide information. It is this action that will be used to
gather data regarding the complicity of others in Barrett's
activities. For instance, Doctor's Data will no doubt demand:
(a) the names on the Barrett's Consumer's Digest newsletter email
list.
(b) the names of any and all contributors, including amounts, to
Barrett's Legal Defense Fund.
(c) The names of everyone, and every discussion group, website, or
blog, linked to Barrett's websites...
(g) All communications with any local, state, or Federal agency where
Barrett may have purported to claim expertise, or where a complaint
was filed by Barrett and his co-conspirators, in regard to Doctor's
Data.
Discovery will ask Barrett and the others just how Barrett's article
float to the top of the search engines. The answers to those
questions will flush out the additional, currently hidden,
conspirators... A lot of professional work needs to be done to move
that article, every time, to the first pages of Google and the other
search engines. The people that do that for Stephen Barrett are just
as guilty as Barrett - and, hopefully, they have VERY DEEP pockets so
they can help pay the 20 million dollar claim.”
Nov. 30,
bolenreport.com:
Bolen expands threats to public health officials: “I suspect that the
mailing list for the so-called `Consumer Health Digest,' once
subpoenaed, and made public, is going to be a treasure trove
containing key information on how the quackbuster conspiracy works.
People whose names, I think, are on this list, will become targets of
health freedom groups for years to come - and they should be. Any, and
every, government employee, at any level, on this list, should
immediately be a highly focused-on target.”
Dec. 8,
bolenreport.com:
Bolen uses second case for more threats, particularly against
anonymous complainants to the Texas Medical Board: “When this info is
provided, I suspect, and the Court will demand it, several things will
happen, one of which will be the convergence of the two Federal Court
cases.
Why will this converge the two Federal Court cases? Because we already
know, for instance, that Stephen Barrett, himself, filed about five
separate Anonymous Complaints against Jesus Caquias MD, mentioned in
the Doctor's Data v Stephen Barrett Federal Court case, and offered
himself as an expert witness against Caquias. More, bobbie baratz,
Barrett's buddy, and president of the NCAHF, was the ONLY witness
against William Rea MD, the Doctor who had six anonymous complaints
filed against him by a New York insurance company who didn't want to
pay him.More - when the AAPS gets copies of the complaints filed
against EVERY doctor in Texas all they have to do is send a copy of
that complaint to the Doctor victim with a questionnaire - and the fur
is going to fly - with a major scandal in Texas that's NOT going to
settle down for a very long time."
