“You're right.   Stephen Barrett has, so far, it seems, missed the
Thursday, September 30th deadline to Respond to the Doctor's Data v
Barrett Federal lawsuit.
So far.”
At this late juncture, the question is not whether Bolen is making a
false report. The question is whether there can be any reasonable
doubt that he KNOWS he is making a false report. So far, as in his
July 16 “report” of an imminent default judgment, his apparent
ignorance, laziness and propensity for self-delusion have been just
enough for a generous person to allow that the answer COULD be yes.
But this time, I judge that the answer must be “no”. I offer as a key
piece of evidence the date September 30. That date is NOT ninety days
from when the FIRST complaint was filed- that would have been
SEPTEMBER 18. Rather, it is ninety days from the filing of the first
AMENDED complaint. Therefore, HIS understanding of the law MUST be
that AN AMENDED COMPLAINT MEANS A NEW DEADLINE. That would mean that,
since a second amended complaint was filed on September 28, Barrett
has until at least October 28- AND BOLEN KNOWS IT. Yet, he still
reported otherwise.

“Yes, it's true, that no papers were apparently filed with the Court
by 5:00PM on that date.  And, also very obviously, no electronic
filing was made by midnight of that same date. And, I checked to see
if Barrett had tried to change jurisdiction to some other Court -
nothing.
Don't get your hopes up, just yet, to be able to start collecting
Barrett souvenirs, however.  There is still one more legal option
available.  Barrett's attorney could have dropped a package in the
mail before 5:00PM on September 30th, 2010, making certain he has a
record of the postmark time.
If not - well, Barrett is heading for a Default Judgment.  Also, the
same for Quackwatch, Inc., and the National Council Against Health
Fraud.”
So, why is Bolen still going on about default judgments? The simplest
explanation is that, on some level, even he doesn't think DDI has a
chance of winning in court. But a darker possibility readily suggests
itself: If he were able to convince people that Barrett already lost,
donations to Barrett's defense fund would dwindle or cease entirely,
and he might lose in fact. That makes his latest “report” not just a
knowing falsehood, but plausibly an intentional effort to change the
outcome of the trial.

“For now, let me amuse you.
The quackbuster minions (and they HATE being called "minions") are
livid about my articles.” Why would we mind being called “minions”?
Such cliches only make it more clear that Bolen's “reports” are
melodramatic fantasies. They also strengthen the possibility that
Bolen had a hand in creating the complaint, which will make it that
much easier for Barrett to convince a court to declare the whole
proceedings a “SLAPP” suit.

“It seems that it is very important to them to be able to control
internet information flow - especially about the Doctor's Data v
Barrett Federal lawsuit.”
Holy lack of introspection, Batman! Let's go over the sequence of
events again: No one complained when Bolen stood up literally alone
among scores of commentators in supporting DDI's suit. I myself wrote
rebuttals to his silliest claims, but seriously debated whether to go
to the trouble of posting it. But then he began making statements
that were clearly intended to silence US. He told us donations to
Barrett would be seized. He told us our private communications and
records would be pried into. He was especially vocal and persistent
in saying that we would be added as defendants in DDI's suit, merely
for being critical of them. So why is HE now the one who complains
that WE sought “to control internet information flow? Presumably
because he wasn't able to do it himself.

“ My articles about the case, for whatever reason (and I am not that
SEO knowledgeable), are floating up to the top pages of Google - and
this panics the minions - so they are taking action.”
So, after weeks of bellyaching that we must be “cheating” to rank as
high as we do in Google searches, NOW he's ready to gloat at appearing
high in the ranks. Consistency, apparently, is one of the few
hobgoblins missing from his mind.

“(1)  They are complaining to my ISP, trying to shut down www.bolenreport.com.”
Who's “they”? Well, I'll cop to it, and I could mention a thing or two
he hasn't brought up. But I'm not speaking for anyone else.

“(2)  They are emailing all those that reprint my articles demanding
that they not link to me.”
I beg to differ: I reckon the very large majority of the Bolen
Report's “circulation” to have been taken out weeks ago. In fact, at
this time, I judge that there is exactly ONE site still deserving
attention.

“(3)  They've started a new blog, just about me, trying to damage my
reputation.”
How could we damage the reputation Bolen has already built for
himself? That would be like launching stink bombs at a putrid whale
carcass.

“(4)  They have contacted, of all things, the Social Security
Administration, claiming I am falsely getting Disability payments. 
Disability payments?  Where'd that come from?
(5)  They have contacted the IRS, claiming I have an income.  Yup”.
And where does THIS come from? Where would “we” get the information
to MAKE a credible complaint to this entities? For that matter, why
does he think the problems he alludes to are recent developments?
Judging from what I've been told about what it takes to get on Social
Security, it seems quite conceivable that whatever investigation they
have about him started even before DDI's suit was filed.

“I have to say that I am relieved.  For almost ten years I have been
`Public Enemy Number One' in quackbuster land.  Then along comes these
upstarts Doctor's Data and their attorneys, and whoosh - I'm pushed
right out of the envied spot, almost overnight.  But, as you can see,
right now, I have pushed my way back to, at least, to tie with
Doctor's Data and their attorneys.”
Bolen flatters himself overmuch. Over fifty people have “blogged”
against DDI just for filing their suit. But, despite my
recommendations, the same people have almost all ignored him.
Perhaps, with his latest malicious hoax, I can change THEIR minds.

“I don't give up what's rightfully mine without a fight.”
But what DOES Bolen have that is his own? He has received hundreds of
thousands from Hulda Clark and other “practitioners”, who as a rule
have ended up bankrupt, delicensed or even convicted of crimes. His
“allies” have spent tens of thousands more on litigation by people he
defamed. His very name and domain “Bolen Report” appears to have been
paid for by Owen Fonorow, whom I believe has lost most of his assets.
The truth is, Bolen would be nothing and nowhere without the “help” of
alternative health practitioners, and all he has ever given in return
is expense and embarassment.

Too late for that, Tim. The best you can hope for is to convince
enough people to pay no attention to you.
