regarding US Patent US20090327171 implications on openprosthetics

Hi

Just went through US Patent US20090327171 "Recognizing gestures from forearm emg signals".

I am not sure, it this patent is applicable ONLY for the people with hands intact and wanting to use myelectric signal to operate some other device.

If this patent also covers prosthetic applications (prosthetic hand in particular) for people , who have lost a hand,
then i am not sure if it ok to use MyOpen_EMG for prosthesis.

can someone please comment on this.?

If so, since all of the myopen code was published before that application was filed, then the patent is invalid.
