Hi EC and Members of MHV Association
There are some specific untenable issues with the Elections being conducted in MHV in the recent terms.
1. Online Voting/E-voting is meant to be an alternative to proxy voting. Proxy voting is a derivative of company law which allows shareholders to participate in the elections if they are away. RWAs somehow are operating in this broader schema. But a proxy voter should produce an ID card and also an authorization from the shareholder/owner to enter the voting premises and cast vote. To prevent this, Online voting/E-voting has been introduced such that the shareholder/owner can cast vote from wherever present, removing the need for proxy.
To this extent, the previous elections or GBM done with online voting are invalid because OTP based proxy voting has been allowed. Many residents have pointed to this and have asked the EC to consider at least facial or biometric verification of the proxy online voters. As usual, it was all ignored and the elections were conducted as is.
Therefore, to clean up the system, EC should allow proxies only in physical ballot, and biometric verification for Online.
2. As per bye-laws or any law or even common sense, all contestants should have equal opportunity during the time of elections. This is completely violated because a) the eligible voter's data is inaccurate, b) the incumbent MC members always have preferential access to this data, but have not bothered to correct it. Neither has the EC corrected it.
If we go by bye-laws, we have to comply with all sections of bye-laws and not whichever seems convenient in a situation.
Request EC to do the needful. And more importantly the MHV members to push the EC and MC to conduct fair and meaningful elections. Else, it is better to not participate in elections or to report to respective authorities.
