We would like to inform you that an Interlocutory Application (IA) has been filed in the Hon’ble NCLAT seeking the handover of maintenance and security services to the AOA.

As committed in our election manifesto, this step is aimed at improving the overall maintenance, security, and functioning of our society. We have held multiple meetings and extensive discussions with legal experts to ensure that this move is both lawful and in the best interest of residents.

This course of action has also been taken following the suggestion of the IRP, who advised that such matters be taken up with a higher authority, in this case, the Hon’ble NCLAT - if the AOA seeks a formal handover.

The Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010 provides a clear legal foundation for this step. According to the Act, the builder/developer is required to hand over the maintenance and related responsibilities to the AOA after the formation of the association.

*We want to clarify that the case filed is not for the complete handover of the society, but strictly limited to maintenance and security services in the interest of better governance*.
