Dear Mr. Nitish Arora,

This is to record our strong objection to your notice sent on 16th October 2025 (as attached) announcing a revision in Common Area Maintenance (CAM) charges from ₹2.05/sqft + GST to ₹2.70/sqft + GST with effect from the same date.

At the outset, you are reminded that the maintenance handover matter of Supertech Czar Suites is presently sub judice before the Hon’ble NCLAT in Company Appeal (AT) (Insolvency) No. 406 of 2022, filed by the Apartment Owners Association.

You are further aware that upon AOA’s objection to a similar attempt in May 2025, the IRP, Mr. Hitesh Goel, had vide his email dated 15th May 2025, directed YG Estate not to increase CAM charges. That instruction remains in force and has never been withdrawn or superseded.

Despite this, YG Estate has now unilaterally announced a hike and is attempting to implement the same through automatic deductions from residents’ prepaid electricity meters, without consent or authority. Such deductions amount to:

# Violation of IRP’s written directive dated 15th May 2025;
# Interference in proceedings currently pending before NCLAT; and
# Unauthorized and coercive financial action against residents.

The AOA hereby demands immediate withdrawal of this revised CAM rate and restoration of the original deduction rate of ₹2.05/sqft + GST. Any excess amount deducted from prepaid meters must be refunded or adjusted immediately.

You are also directed to maintain strict status quo with respect to CAM charges until the Hon’ble NCLAT passes further orders.

We are marking a copy of this letter to IRP Hitesh Goel with a request for urgent intervention and necessary directions to ensure compliance with his earlier instructions.

The AOA reserves its right to place this unauthorized action before the Hon’ble NCLAT and seek appropriate directions, including for contempt and coercive recovery.

Dear Authorized Signatory,

We appreciate your efforts to maintain the society's upkeep despite financial constraints. However, we strongly believe the proposed CAM charges increase is unjustified, given the subpar services provided by YG Estates.

The increase from Rs. 2.05/- to Rs. 2.70/- per sqft + GST is significant, and we expect substantial improvements in services. We request a detailed breakdown of how the additional funds will be utilized and specific measures to address existing issues.

Some concerns include:
- Inadequate maintenance of common areas
- Frequent power outages and water supply issues
- Poor waste management
- Unresponsive customer service

We urge YG Estates to reconsider the proposed increase and engage in discussions with residents to address concerns and explore alternatives.

This is not only an unjust hike but an illegal one. A decision cannot be unilaterally imposed on the apartment owners without taking the owner’s representative body AoA into confidence that too when the matter related to your very continuation in Supertech Czar has been questioned in the court of law. 
You are a service provider, sustaining on money paid by us owners. If you cannot provide the service, pay the water and electricity dues to the GNIDA and NPCL using the already collected money in that head and pack your bags and leave.

I strongly disagree with the decision to increase CAM charges without providing adequate services. Furthermore, I find it insensitive to impose this unreasonable demand during Diwali, a highly auspicious festival. It seems to disregard our religious sentiments.

You can not unilaterally increase the CAM charges without the prior consent of the AOA and residents. If you are unable to manage the facilities within the existing approved rate, you may choose to discontinue your services with prior notice as applicable and as per agreement.

It is a time when Government is easing GST burdon and providing relief to citizens, your move stands completely misaligned with that initiative.

The recent increase in maintenance charges is unacceptable in light of procederal gaps & your inability to manage the show cannot be a justification for such steep  hike.We cannot continue to pay more for less.Revert these charges with immediate effect and go through proper channel.

We condemn this sudden notice of hike in CAM charges despite existing services not being on par with current rates. There is no justified ground to increase the CAM charges, especially without the consent of the AOA and residents. 

Please reverse it immediately.
