Application No. 26-049: Robert and Lisa Franz, c/o Conor Walsh, 20 Rascally Rabbit, Unit 1A, Marstons Mills, MA 02648, owners of property located at 43 Marion Lane, also shown on the Town of Chatham’s Assessors’ Map 15I Block 29 Lot G6. The Applicant proposes to install an exterior mechanical system appliances (A/C condensers) 18.3 feet from the easterly abutter where a 25 foot setback is required. The property contains 21,200 square feet in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Protective Bylaw.

The Applicant proposes to install an exterior mechanical system appliances (A/C Condensers) within the Coastal Conservancy District where a 50 foot setback is required. The property contains 33,965 square feet in the GB1 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Protective Bylaw.

Application No. 26-051: Sydney Realty Trust, c/o Willliam G. Litchfield Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 23 Wood Carver Knoll, also shown on the Town of Chatham’s Assessors’ Map 11D Block 32 Lot 4A. The Applicant seeks to modify Special Permit No. 23-041 granted on June 8, 2023, which allowed for the construction of an addition. The Applicant now seeks to modify this Special Permit to allow for an increase in building coverage and the construction of a new accessory structure (garage/pool house). The proposed garage/pool house will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, requires the grant of a Special Permit. The building coverage approved under Special Permit No. 23-041 was 1,795 square feet (10.6%), the constructed building coverage was 1,800 square feet (10.7%) and the proposed building coverage is 2,485 square feet (14.7%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 16,870 square feet where 20,000 square feet is required in the R20 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.

Application No. 26-052: Robert Fitzpatrick, 68 Diane Drive, Chatham, MA 02633, owner of property located at 68 Diane Drive, also shown on the Town of Chatham’s Assessors’ Map 6C Block 76 Lot G112. The Applicant proposes to install exterior mechanical system appliances (A/C Condensers) 7.5 feet from the westerly abutter where a 15 foot setback is required and within the Coastal Conservancy District where a 50 foot setback is required. The property contains 8,100 square feet of land area in the R20 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Protective Bylaw.

Application No. 26-053: Chatham Productions LLC, c/o Victoria Clark, 1234 Chestnut Street, Newton, MA 02464, owner of property located at 776 Main Street, also shown on the Town of Chatham’s Assessors’ Map 14E Block 37 Lot 56. The Applicant proposes to change, alter, or expand a nonconforming commercial structure (Washington Taylor House) on a conforming lot via the construction of additions. The existing structure is nonconforming in that it is located 10.7 feet Main Street where a 25 foot setback is required. The proposed partial second floor and additions will comply with the dimensional requirements of the Bylaw. The existing lot coverage is 11.8% and the proposed lot coverage is 63.2% where 70% is the maximum allowed. The lot contains 116,143 square feet in the GB2 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 26-054: Chatham Productions LLC, c/o Victoria Clark, 1234 Chestnut Street, Newton, MA 02464, owner of property located at 776 Main Street, also shown on the Town of Chatham’s Assessors’ Map 14E Block 37 Lot 56. The Applicant proposes to construct two residential apartments incidental to a commercial use in a GB2 zone which requires the grant of a Special Permit. The lot contains 116,143 square feet in the GB2 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections III.C.4.c.4. and VIII.D.2.b. of the Protective Bylaw.

Application No. 26-042: Queen Anne Chatham LLC, c/o James M Norcross, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 70 Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 13E Block 15 Lot 14. The Applicant seeks Dimensional Variances from the buildable upland area requirements for 5 additional rental units and 2 additional staff/managers apartments. A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Protective Bylaw. Under Application No. 26-043, the Applicant proposes to change, alter, or expand a nonconforming hotel/restaurant on a conforming lot via the removal of the restaurant to allow for the renovation of the Inn to create 5 additional rental units and the renovation of Guest House No. 1 to allow for two additional staff/managers apartments. The existing Inn is nonconforming in that it is 20.7 feet from the road where a 40 foot setback is required and 23.5 feet from the southeasterly abutter where a 25 foot setback is required. Guest House No. 1 is nonconforming in that it is located 14.2 feet from the southwesterly abutter where a 25 foot setback is required. The structures contain 34 rental units plus staff/managers apartment on a lot containing 57,848 square feet of buildable upland where 112,000 square feet is required. The proposed 5 rental units and 2 staff/managers apartments require an additional 35,000 square feet of buildable upland area. The building coverage will remain nonconforming at 8,891 square feet (15.4%) where 10% is the maximum allowed. The lot contains 65,512 square feet in an R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. Continued from June 25, 2026.
