Application No. 25-036: Blue Heron Realty Trust, c/o William Benajmin, PO Box 1067, South Orleans, MA 02662, owner of property located at 27 Strong Island Road, also shown on the Town of Chatham’s Assessors’ Map 12M Block 16 Lot B19. The Applicant proposes to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of a landing. The existing dwelling is nonconforming in that it is located 29.1 feet from Rush Drive where a 40 foot setback is required and 24 feet from the Coastal Conservancy District. The proposed landing will be nonconforming in that it will be located 19.1 feet from the Coastal Conservancy District where a 50 foot setback is required. The lot is nonconforming in that it contains 37,700 square feet where 40,000 in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Also proposed is the demolition of the existing boathouse and the construction of a new boathouse. The existing boathouse is nonconforming in that it is located 14.9 feet from the westerly abutter. The proposed boathouse will be nonconforming in that it will be located 11.8 feet from the westerly abutter where a 25 foot setback is required. The lot contains 67,172 square feet in the R40 Zoning District. A Special Permit is required under M.G.L. Application No. 25-039: Ana Lotharius and John Schafer, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 77 Sachemas Way, also shown on the Town of Chatham’s Assessors’ Map 7I Block 24 Lot C237. The Applicant proposes to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of an addition. The existing dwelling is nonconforming in that it is located 39.5 feet from Sachemas Way. The proposed addition will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit. The existing building coverage is 2,125 square feet (10.9%) and the proposed building coverage is 2,795 square feet (14.3%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 19,526 square feet where 60,000 square feet is required in the R60 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 25-041: John J. Linnehan and Jacqueline C. Chapter 40A, such substantial alteration requires the grant of a Special Permit. Application No. 25-040: Michael Alfred Radon and Hailey C. Radon, c/o William G. Also proposed is the installation of additional exterior mechanical system appliances (A/C condensers). The existing dwelling is nonconforming in that it is located 20.9 feet from the southerly abutter and 19.5 feet from the northerly abutter. The existing exterior mechanical system appliance is nonconforming in that it is located 17.1 feet from the northerly abutter. The proposed addition will be nonconforming in that it will be located 15.7 feet from the southerly abutter where a 25 foot setback is required. The proposed exterior mechanical system appliances will be nonconforming in they will be located 16.1 feet from the northerly abutter where a 25 foot setback is required. The existing building coverage is 2,203 square feet (4.9%) and the proposed building coverage is 3,094 square feet (6.8%) where 10% is the maximum allowed. The lot is nonconforming in that it contains 125 feet of frontage where 150 feet is required. The lot contains 45,273 square feet in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 25-042: Tacoma Partners Limited Partnership, c/o Brain J. Wall, Esq., 90 Route 6A, Sandwich, MA 02563, owner of property located at 489 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14A Block 10 Lot 8. The Applicant proposes to change, alter, or expand a nonconforming dwelling on a conforming lot via the installation of a new foundation under the existing dwelling. The existing dwelling is nonconforming in that it is located 36.7 feet from Stage Harbor Road where a 40 foot setback is required and 13 feet from the Coastal Conservancy District where a 50 foot setback is required. The foundation which was installed increased the building height within the required setbacks by 0.3 inches. The lot contains 51,600 square feet where 40,000 square feet is required in the R40 Zoning Districts. A Special Permit is required under M.G.L.
