8:00: Public Hearing:

The Town of Berlin Planning Board will hold a public hearing on Tuesday, Oct. 28, 2025, at 8:00 p.m. The purpose of the public hearing is to provide interested parties with an opportunity to comment on proposals to amend the Town of Berlin Zoning By-Laws pursuant to M.G.L. c.40 A section 5 to be acted upon at the Special Town Meeting to be held November 17, 2025

The public hearing will be held on the Zoom virtual meeting platform.

Interested citizens may present oral feedback at the hearing or may send written comments to the Planning Board prior to the hearing via email to plan...@townofberlin.com or US MAIL to: Berlin Planning Board, 23 Linden Street Box #6, Berlin, MA 01503.

The proposed amendments to the Zoning By-law would be:
Article 1: To see if the Town will amend Section 444.3 of the Zoning Bylaw by deleting the current language and replacing it with the following:
“A Highway Shopping Center may include drive up facilities for banks, pharmacies, fast food restaurants and other retail and service uses.”
and in “Article 14; Definitions; Regional Shopping Center” delete the words:
“A group of commercial establishments (including, without limitation, retail and service establishments, one or more restaurants or other establishments serving food on the premises, movie theaters, and such other uses customarily found in a regional shopping center)”

and replace them with:

“A group of commercial establishments (including, without limitation, retail and service establishments, one or more restaurants or other establishments serving food on the premises or with drive up facilities, movie theaters, and such other uses customarily found in a regional shopping center)”
Article 2: A Citizen’s Petition that would amend language in Section 444.3 Highway Shopping Center Overlay District and Section 454.2 Village Overlay District with the deletion of language excluding drive up facilities for fast food restaurants in the Highway Shopping Center Overlay District and the addition of language regarding restaurants in the Regional Shopping Center Overlay District and the Highway Shopping Center Overlay District.

A full copy of the proposed Zoning by-law amendment is on file with the Town Clerk for review during normal Town Clerk office hours or at www.mytowngovernment.org.
