A former biker gang member who told the Parole Board of Canada in February to ignore warnings from police that his life was in danger was assaulted while behind bars five months later and had to be treated in a hospital.

Jean-François Emard, 43, tried several years ago to revive the Rock Machine biker gang. A criminal organization by the same name was once part of an alliance that went to war with the Hells Angels in Quebec — between 1994 and 2002 — over drug trafficking turf. Near the end of the conflict the few remaining members of the Rock Machine decided to become members of the Bandidos, an American-based biker gang, and their former club’s name disappeared. But in 2014, Emard suddenly emerged wearing the gang’s name and colours and confirmed to reporters that he was reviving the Rock Machine.

Four years later, in March 2018, Emard received a 33-month sentence after he was convicted of having possessed a firearm and drugs while parading around in Rock Machine gang colours. The sentence included a 30-month sentence he received later, on May 2, 2018, after he was found guilty of having committed an indecent act by having sex on the hood of a car parked on the side of a public roadway.

In May 2019, Emard was granted day parole, but before he could leave the penitentiary Correctional Service Canada was advised by police that they believed his life was in danger. No halfway house was willing to take the risk of having Emard as a resident and his day parole was suspended.

When Emard came up for parole again in February, he claimed the Sûreté du Québec lied about the alleged threats to his life because he is currently suing the provincial police over how one of its officers, Bruno Landry, assaulted him in a detention cell (Landry received a 60-day suspension). According to court records, the lawsuit was filed in 2017 and has yet to be settled. Emard is seeking $475,000 from Landry, the SQ and Quebec’s attorney general.

The parole board agreed to lift the suspension on Emard’s day parole during that February hearing. Weeks later, he reached his statutory release date, the two-third mark of his sentence, but the parole board imposed several conditions on the release, including an order that he wear a GPS-locating bracelet.

According to a summary of the board’s most recent decision made on Friday, Emard violated the conditions of his statutory release a few times. This included how, on May 3, his bracelet revealed he travelled 50 kilometres outside of the area he was limited to be within. When he was questioned about the breach, Emard told his parole officers his “chauffeur” must have misunderstood his directions while he was supposed to buy some home appliances while working. The “chauffeur” turned out to be a convicted criminal, but Emard’s parole officers decided the incident did not merit returning him behind bars.

However, Emard failed a urinalysis test a few weeks later. He tested positive for cannabis and his release was suspended. According to the summary, shortly after he was returned to a penitentiary, Emard was attacked by other inmates.

“Your injuries necessitated a transfer to an outside hospital. It should be noted that charges are supposed to be filed against your aggressors,” the board wrote its decision to revoke Emard’s statutory release.

Their decision was based, in part, on how on July 11, when Emard was transferred from the hospital back to a penitentiary, he was searched and was found to be carrying medication that he didn’t have a prescription for as well as a small amount of cannabis.

A former outlaw motorcycle gang member claims the Sûreté du Québec lied about threats made on his life in order to keep him behind bars.

The claims made by Jean-François Emard, a man who tried to revive the Rock Machine biker gang in Quebec, are described in a written summary of a decision made by the Parole Board of Canada on Thursday. The board decided to lift the suspension of Emard’s day parole, which had been granted in May 2019 based on information supplied by the SQ. The suspension was imposed just days after Emard was granted day parole because a halfway house was unwilling to assume the risk of having Emard as a resident.

During his hearing on Thursday, Emard told the parole board he believes the SQ lied about the threats because he is currently suing the provincial police over how one of its officers, Bruno Landry, assaulted him in a detention cell (Landry received a 60-day suspension). The Rock Machine started out in Montreal in the early 1990s. The group became part of an alliance of criminal organizations that fought the Hells Angels over drug trafficking turf all over Quebec. The conflict, which became known as Quebec’s biker gang war, stretched from 1994 to 2002. The people who remained in the Rock Machine near the end of the war either defected to the Hells Angels or joined an American-based gang called the Bandidos. The Rock Machine name seemed to disappear after 2002 when, in 2014, Emard suddenly emerged and told reporters he was reviving the gang.

Now, the gang’s name appears to have taken on a life of its own. A group claiming to be the Rock Machine Motorcycle Club on Facebook appears to have established chapters in 10 countries. But Emard appears to want to have no part in it. He has admitted in the past that he received threats from the Hells Angels but, he claims, those days are over. He repeated to the parole board on Thursday that he is no longer associated with the Rock Machine.

“You have explained that the Sûreté du Québec regularly contacts Correctional Service Canada to report threats that have been made toward you. You have drawn a parallel with that situation and how you are currently suing that police force,” the author of the summary wrote. “You argue that you are doing all that you can to become a person who respects the law. During the hearing you said you are not being threatened and that you have no reason to fear for your safety or that of your entourage.”

Despite Emard’s claims, his lawyer made a special request that his entire parole hearing be held as a closed-door hearing. It is was an extraordinary request which barred any media from attending. Under normal circumstances, the parole board agrees with such requests but only bars media from hearing an offender’s release plan, which could involve details like the name of a halfway house the person will be heading to. It appears the parole board granted the request while stating that “the right to have a fair hearing where you can express yourself without constraint or fear for your life is counterweighted by the public’s right to information.”

The parole board agreed to lift the suspension of Emard’s day parole, in part, because he has already qualified for a statutory release by having served two-thirds of his sentence. The board imposed a long series of conditions on the release, including a curfew and the requirement that Emard provide proof to his parole officer that he either has a job, is studying or performing volunteer work until his sentence expires.

A police investigation during the spring of 2017 revealed Emard was the head of a drug trafficking ring and when his house was searched police found drugs like cocaine, methamphetamine and cannabis. They also found a firearm stuffed in his couch. According to a court decision delivered in his case last year, Emard claimed he took the gun from the member of a “rival gang” who “wanted to make sure Mr. Emard would be unable to walk for the rest of his days.”

The same decision details how Emard also claimed that a Hells Angel had set fire to his home in 2010 and that someone was willing to pay $50,000 to end his life. (Greg-This would be before Mr.Emard started up the Rock Machine again.)

Jean-François Émard, the presumed boss of the Rock Machine biker gang, has pleaded not guilty to a variety of charges after being arrested by Quebec provincial police Sunday night.

The Sûreté du Québec arrested him in Valleyfield, about 45 minutes west of Montreal, after stopping him for a traffic infraction.

On Monday, Émard pleaded not guilty at the Valleyfield courthouse to charges including possession of cannabis, possession of methamphetamine with the intent to distribute and possession of a dangerous weapon.

He will remain in custody until a new hearing is convened to determine the parameters of his conditional release.

Reforming the Rock Machine
Last month, Émard publicly stated he was trying to revive the biker gang in Vankleek Hill and Hawkesbury in Ontario, just across the Quebec-Ontario border and not far from Valleyfield.

Since then, authorities in and around Hawkesbury have been actively working to dissuade the reformation of the gang on their territory.

The Rock Machine battled the Hells Angels in Montreal in a bloody turf war in the mid-1990s.

In 2014 Émard assured the press that the war with the Hells Angels was a thing of the past and that the new Rock Machine wanted to live at peace.

In 2016 Émard was arrested on suspicion of opening fire on a group linked to the Hells Angels in a bar in Casselman, Ontario. He has been warned by the police multiple times his life is in danger.

A member of the Hells Angels has launched a defamation suit against a Surrey, B.C., blogger committed to "outing" members of the gang.

In a B.C. Supreme Court notice of civil claim, Damiano Di Popolo claims a series of five articles published on Dennis Watson's Gangsters Out blog have exposed him to "contempt, ridicule and hatred."

Di Popolo says the posts imply he's a member of a criminal organization involved with a drug trafficking and stolen car ring.

But he claims nothing could be further from the truth.

"Mr. Di Popolo is an honest family man who has a loving common-law wife and six children with a seventh child on the way," the claim reads.

"He is dedicated to his family. He coaches little league, contributes to charity, attends the Catholic Church and is a member of the Italian community."

'Standing up for the truth'
A 2011 B.C. Supreme Court ruling identified Di Popolo as a member of the Hells Angels.

According to the claim, Watson's articles said the longshoreman was "president of the Kelowna Hells Angels that was charged in a large drug trafficking ring and convicted in of a huge stolen car ring."

Di Popolo claims Watson also implied he sent someone to the blogger's home to threaten him and scare his daughter.

But Di Popolo says he has never been charged with a criminal offence or convicted, and the Kelowna Hells Angels have never been collectively charged either.

He says he "makes an honest living" working at the docks. And he denies making any threats to Watson or his family.

In addition to suing for malice and defamation, Di Popolo sought an injunction forcing Watson to remove the posts in question.

The application has been adjourned, but on his blog, Watson says he "cut a deal and took them down."

He also wrote that he agreed not to talk about the case, except to one reporter.

"He asked me if I had any regrets," Watson wrote.

"I told him I regret this has adversely affected my children, but I don't regret standing up for the truth

Di Popolo claims the Supreme Court of Canada, the B.C. courts and the B.C. government have never labelled the Hells Angels a criminal organization.

Last year, the Manitoba government became the first in North America to label the club a criminal organization.

None of the allegations have been proven in court.

In October 2014, 47-year-old British man Conrad Toland was arrested by Spanish police in Madrid and brought before the National Court in Madrid to face extradition proceedings to Belgium where he was wanted to complete a 10-year sentence for smuggling 155 kilograms of cocaine into the country from Ecuador in July 2011 inside a tuna shipment. He then supplied the drugs to the Hells Angels chapter in Bruges. He also faced charges in Belgium of membership in an armed gang and money laundering.[100][101]
