SECTION  80P(2)(d) DEDUCTION FOR COOPERATIVE SOCIETIES FOR INTEREST RECEIVED FROM COOP BANKS

There are a lot of noticed issued to disallow the claim of societies getting interest from cooperative Banks . The ground is Flimsy and the reasoning is that coop Banks are not societies etc.

I am enclosing a judgement of Lands end which is directly on the issue and clears all doubt.
No appeal can be made to the HC as the Tax effect in this appeal is below the treshhold of Rs 20 Lacs

Dear CA Alok  Saksena,

Thank your very much for your valuable judgement.  It is going to help a number of societies when they go for CIT Appeal or Tribunal.

The issue is with Central Procession Unit (CPU) at Bangalore, where all 80P (2) (d) deduction on account of interest earned from the cooperative banks are disallowed.

Then few CA have shown this order and have also got the rectification. done by the rrespective Assessing officers also.

This is a big disturbances to the cooperative housing society to get into all these litigations.

We have represented before the ICAI and now we will be directly referring to CBDT also on behalf of our association.

I am happy that person like you share all these information for the benefit of all.
