Hey ladies!

Below is a response from a guy my dad knows who used to work for the patent department at RIM. He has the breakdown of the fees for a patent (which might be handy if we choose to do it in the future).

Sorry for the delay.

1.       The costs below are for a “small entity” which is a company that is 50 people or smaller or a university.

a.       Filing fee $200

b.      Examination fee $400

c.       When the patent office objects and you need to file a response/amendment to the application $400 (each time).

d.      Final fee when the application is allowed $150

e.      Every year from the second anniversary of filing a maintenance fee is due.  For the first 3 years it is $50, then goes up to $100 for a few more years, then $125, and so on. See http://laws-lois.justice.gc.ca/eng/regulations/SOR-96-423/page-41.html#h-69 .  The fee is due whether the application is pending or the patent is granted.

2.       The above are the government fees for Canada I assume the costs for the US are comparable. There is of course Europe as well if one cares. On top of that are the drafting fees and the fee to respond to patent office objections. Patent agents charge between $250 and $650 per hour. At RIM we didn’t care how much they charged since we had a cap of $10,000 per patent application. The $250 / h guy can do it in 40 hours. And the senior hot-shot partner who charges $650 better finish it in 17 hours or so or he will have to work an extra few hours for free.

3.       I was not aware of any “patent staff” at UW.  I was once told that Communitech had a patent department. But when I asked I was given the name of a patent lawyer that I already knew and who works at a local firm. I went to uwaterloo.ca and did a search on “patent” and just got that article:

4.       I know people at local firms but they are going to be pricey. Look at the numbers I gave above and think. Also refer to the above article.  One of the things I wanted to do was work with small companies to do initial patent drafts, at a small cost. Then after that they can take it to a firm where an experienced agent can polish it up and file it. So that maybe an option if you guys think you want to save. I am going to Egypt in 10 days though and will be there for 2 months inshaAllah.

Salam

Have a question on patents.

Suhaila and her group did some projects as part of their study are UW.
Some people told them they should patent the ideas.

Some referred them to the university patent office. Not sure if they will
pay and own it, or the university will own it and they pay the fees.

So, the questions:

- How much does it cost to patent something?
- Is the university staff a safe bet?
- If not, do you recommend someone that can do it?
