EU Copyright Consutation Question 8 "making available"

One of the issues that may come up in the context of Firefox is file
sync. If we ever end up integrating with file hosting services (dropbox,
or even part of Firefox accounts natively) with the Firefox download
system, is it clearly legal for users,service providers, and us as the
user agent to sync a users personal files across countries without
copyright problems?

What does "making available" mean in this context?

You mean if those files happen to be copyrighted by someone other than
the user, e.g. a Top 40 music file?

AIUI, this right is relevant when making available "to the public".
Giving a user back their own files may not qualify.

To put it another way: many services do this now; it's unlikely it's
illegal...
