The below information is taken from the Fairfax County Code:

Every tow company which engages in the towing of trespassing vehicles
shall prominently display at its main place of business a
comprehensive list of all its fees for towing, recovery and storage
services and the company's normal business hours. A tow operator shall
not collect from the owner of a towed vehicle charges in excess of
those posted.

This section shall not apply to vehicles towed, stored, or both towed
and stored at the request of a law enforcement officer.

(1)
The maximum fees allowed to be charged are:

(A)
Initial hookup and tow fee not to exceed $50.00.

(B)
Vehicle storage at a rate not to exceed $25.00 for up to the first 24-
hour period and shall not exceed $25.00 for each subsequent 24-hour
period or any portion thereof for the safekeeping of vehicles or
trailers.

(C)
Release fees may be charged for vehicles claimed by the owner after
normal business hours. No release fee may be more than $15.00. No
other fees for release or administration may be charged.

(2)
Towers may not charge additional fees for the use of a cable, flatbed,
or dolly. Fees for extensive and unusual recovery and towing
operations, including but not limited to the use of specialty
equipment, may be charged at a reasonable rate.

(3)
In all cases where a fee is paid, the tow truck company must provide
the vehicle owner with a receipt that bears the complete name and
address and telephone number of the tow truck company. Such receipt
shall itemize all fees assessed in the towing, storage, and release of
said vehicle. Such receipt shall include a printed notice stating that
towers shall agree to mediate all complaints submitted to the
Department of Cable Communications and Consumer Protection for
resolution.


(h)
A tow company or tow truck operator shall not require a vehicle owner
to sign any waiver of the owner's right to receive compensation for
damages to the owner's vehicle as a condition of the owner retrieving
the towed vehicle.

(i)
A tow company shall prominently display at the storage site, in a
conspicuous place in that portion of the premises normally issued for
receipt of payment, a sign which is readily noticeable and readable.
The sign shall be furnished by the Department of Cable Communications
and Consumer Protection, listing the Department's telephone number and
informing consumers that they may contact the Department for
assistance.

(j)
A tow company or tow truck operator shall neither offer nor give any
rebate, payment, or other compensation to a property owner or other
person contracting for, authorizing or requesting the towing or
removal of a vehicle.

(k)
Except as otherwise provided by this Section, any violation of Fairfax
County Code § 82-5-32 shall be punishable as a Class 3 misdemeanor.

Thank you for such good and prompt research.

If I am reading this correctly, A towing company can only charge $65.00 plus $25/day of storage.  If I am reading this correctly that tells me that a $175.00 fee would include at least 5 days of storage.  Does anyone read this any different?

Miguel, I would agree that your numbers add up. IF the story told to Bob is correct. As we have already found out, the second neighbor that told him about their "second vehicle" actually ended up being their "third vehicle", quite a difference. We all have to be careful about the stories our neighbors tell us. Most times I am sure they are trying to be fully truthful, but sometimes the truth becomes what we want it to be.

Bob, The one thing I can tell you for sure, is that NO ONE IS GETTING ANY KICKBACKS FROM THE TOWING COMPANY!!

We have hired Henry's towing company and made it clear to them that we do NOT want them to be aggressive, and no one's cars should be towed from their own space unless they have a major violation. I am not going to debate what is a "major violation", but suffice it to say it is NOT parking 2" over the curb, front end in. I am convinced this "neighbor" did more than that when they were towed.

At any rate, we wanted enforcement, and enforcement is what we have. The BOD took the action we believed necessary to get our neighborhood cleaned up. We are working very hard to continue that, and parking is apparently a problem in several areas of the community.

If anyone knows for a fact that the towing company is getting really aggressive, please bring it to the BOD quickly so we can nip it in the bud. I lived in a community in Northern Alexandria where this was the case. Unfortunately we did NOT have a BOD, and had no recourse as the management company was on the side of the towing company as they were getting kickbacks for every vehicle towed. Not a good situation at all, and one that I shall never forget.

My parents were visiting for Thanksgiving, and their car was towed for
parking over the curb. Luckily, my father noticed before the truck got
too far and was able to free their car for $75.

I should clarify that my parents' car was not towed on Thanksgiving
day, but rather the Friday after. Dad had backed in to the spot, if
that makes any difference.

Dear Residents:

The towing rates are regulated by Fairfax County and Henry's should follow
these rates. We confirmed this with them(i.e. Henry's) when the association
hired them to petrol the property. Once again I confirmed this with them
(i.e. Henry's) today. The rates with the explanation are posted on their
location (this per FFX county requirement). the lot manger assured me that
there is no abuse and they will get in trouble if they do that.

He (i.e. the lot Manager) informed that the truck driver is allowed to drop
off a car in the property only if the owner showed a proof of ownership of
such car. If not, he has to take it to the lot. In this case, the
resident(s) should get a receipt from the driver.

According to the lot manager, if the driver over charged the resident Henry's
will refund the money back after the resident present a receipt of such
charge and the manger investigates the matter with his driver.

If the resident(s) feel that the towing company is being unreasonable, they
should contact us (i.e. the management company) and we will address the
matter accordingly.
