 On the House Floor of interest

 

The House brought up HCS SB 501, sponsored by Rep. Stephens, which includes 2017 designated as the opioid addiction free decade, allows person to receive deceased loved one's medical record. Rep. Bondon added HA1 which is the Hospital licensure bill. Rep. Pike added HA 2 which relates to mental health in Missouri, HB 316, which allows licensure of psychologist. Rep. Wiemann failed to adopt HA 3 which is the chiropractor bill. Rep. Stephens added HA 4 which would allow pharmacist to administer immunization. Rep Sommer added HA 5 which pertains to mental health service dogs. Rep. Morris added HA 6 which pertains to the dispensing of narcotics. Rep. Helms added HA 7 which increases the mileage for collaborative practice to 75 miles. Rep Alferman added HA 8 which is the epi pen bill. Rep Evans added HA 9 which is the CBD oil expansion bill. Rep. Swan added HA 10 which is the same as HB 100 and would allow Missouri to become a member state for the EMS Alliance. The floor leader called a PQ and HCS SB 501 was third read and passed by a vote of 141-8. The emergency clause failed by a vote of


The House moved to Bills Carrying Request Messages and took up SS HCB 3, which is the senior services protection act. SS HCB 3 was TAFP by a vote of 83-67. The Emergency Clause failed to be adopted by a vote 32-115.

Senate floor of interest

 

The first item on the agenda on Monday, was a motion to reconsider the vote on HCB 3 that establishes the Senior Services Protection Fund. When this bill hit the floor last week, there was a floor amendment adopted that changed the bill from centering on the elimination of the renter’s portion of the circuit breaker tax to sweeping various funds to pay for Medicaid provider rates. The body brought back up the bill to adopt some technical changes, which would make the bill more palatable to the House.

 

The Senate then moved to privileged motions. Senator Schatz moved that the conference committee for HB 90 which establishes a prescription drug monitoring program, be allowed to exceed the differences. Senator Kraus was quick on his feet to offer a substitute motion to keep the conference committee to working out only the differences between the House and Senate versions. His motion was successful.

 

The body then truly agreed and finally passed SB 66 by Senator Schatz on workers compensation changes and SB 161 by Senator Sater that establishes the Ozark Exploration Bicentennial Commission.

 

They moved back for the House Bills for Third Reading Calendar. The body was able to truly agree and finally pass HB 336 by Rep. Noel Shull that providers riders, endorsements, and amendments to life insurance policies may contain suicide exclusions or limitations. After lengthy debate, HB 292 by Rep. Sandy Crawford on the powers of banks was laid over on the informal calendar. HB 190 by Rep. Conway was then brought up for debate and truly agreed and finally passed. This bill would allow community college police officers to establish regulations to control vehicular traffic on any thoroughfare owned or maintained by the college.

 

On Tuesday, the Senate spent most of the day working on HB 452 by Rep. Kevin Austin that modifies definitions of 'employee' and 'physician employee' in actions against health care providers for personal injury or death. Senators Schaaf and Onder held the floor in opposition to the bill which was laid over. The body then moved through conference motions on Senator Sater’s SB 139, which had earlier in the day been loaded up with amendments in the House and then Senator Hegeman’s SB 283 on special road districts.

  

WHAT CROSSED THE FINISH LINE

 

Healthcare

 

SB 50  - Senator Walsh’s bill that she has been pushing for several years on a health care directives registry was able to finally make it. This bill also included language on hospital licensure, assistant physicians, x-ray inspection, neonatal and maternal levels of care, newborn screening and STEMI and trauma center designations.

 

SB 501 - Senator Sater’s bill became another omnibus health care bill including provisions on health care records (this is a add on to the bill that could be of concern); a health care directives registry; drug or alcohol overdoses; epinephrine auto-injectors; hospital licensure; immunization education; sports medicine;  assistant physicians; physician assistants; psychologist internships; vaccine protocols; speech-language pathologists and audiologists;  medication-assisted treatment; and  a drug take-back program.

 

SB 139 - Senator Sater’s MO Rx Bill also became home to other pharmacy related issues including the emergency administration of epinephrine, language on polypharmacy and antipsychotic medications, prescription drug rebates, income based requirements for the MO Rx Program, delegation of physical therapy treatment and the creation of the RX Cares for Missouri Program.  

 

WHAT DIDN”T  Healthcare

 

HB 90 - PDMP once again couldn’t make it to the Governor’s desk. Rep. Holly Rehder worked her magic getting the bill out of the Senate, but with locals now leading the charge on the issue, many saw the compromise on the bill as a lesser solution than what many counties are already doing.

  

HB 144 – Adult Consent Bill – We do not support this bill the way it is currently written.  Hopefully, next year we will get a chance to make changes to the bill to make it work for everyone.

 

HB 165 – Advance Practice Nurses – we supported this bill and it did not move forward.  Hopefully, it will be reintroduced next year.

 

HB 405 – Coroner Bill - A bill that we supported and asked for – made it out of committee but never got a vote on the House floor.  We hope to have it back again next session. 

 

HB 440 – Simons Law – Which we do not support the way it is currently written.  Again, some better language could make a difference in this bill. 

 

Two bills were filed this year to change Certificate of Need Requirements for long-term care facilities, but with a big budget battle this year, CON reformed seemed to take a back seat.

 

COMING UP…

 

Whispers of  a special session are already swirling. There are a handful of topics the Governor could call a special session on including more tort reform legislation, economic development issue down in the bootheel for a company looking to place an iron smelter and ethics reform. I don’t see any healthcare bills coming in a special session but we will watch.  I will let you know.
