
COMMITTEE HEARINGS OF INTEREST
House Judiciary
On Thursday Rep. Joe Don McGaugh’s House Judiciary Committee met to vote out his HB 144 that would establish the “Designated Health Care Decision-Maker Act”. The only amendment that was added was offered by Rep. Joe Don McGaugh that would delete line 24 in section 404.1107, page 11 and insert “employee thereof that makes good faith efforts to”. This bill will now head to the House Rules - Legislative Oversight Committee chaired by Rep. Shawn Rhoads.
Senate Appropriations
The Senate Appropriations Committee heard testimony from the Department of Mental Health and the Department of Health and Senior Services on Tuesday. Then on Wednesday the Committee heard from the Department of Revenue, Lottery and the Department of Transportation.
House Health and Mental Health Policy
The first bills to be heard this week in the House Committee for Health and Mental Health Policy were HB 123 and HB 125, both sponsored
by Rep. Frederick’s, which pertain to the Right to Shop Programs. This program would require a health care provider to provide the cost of non-emergency services and/or procedures if requested by the patient. Similar legislation was filed last year but did
not reach the finish line. Opportunity Solutions Project and the Foundation for Government Accountability testified in support of the legislation while Anthem Blue Cross Blue Shield, the Missouri Hospital Association and the St. Louis Area Business Health
Coalition all opposed the bill.
The next bill heard in committee was HB 455, sponsored by Rep. Bahr, which is the structured family care bill. This bill is identical to legislation filed last year. It would ask for a waiver from the department to be able to use Medicaid dollars to reimburse
those family members involved in home care of another family member. Currently, family members cannot receive payment for in home care for family members. The bill received numerous testimonies in favor including Paraquad, Delta Centers, Missouri Senior League
and the Missouri Assisted Living Association, stating that this legislation would allow a caregiver to continue being able to provide in-home care and prevent caregiver burn-out, which was stated as the leading reason for family members placing loved ones
in nursing homes. The Missouri Council for In-Home Services spoke in opposition stating that they felt this legislation could potentially lead to the loss of 20,000 patients.
The final bill to be heard in committee was Rep. Korman’s HB 691. This bill allows for the state to require the Department of Social Services to request a waiver to require certain MO HealthNet participants to be Missouri residents for 6 months before receiving
benefits. The purpose of this legislation is to keep people from coming to Missouri to take advantage of Medicaid benefits. This bill received no testimony in favor, but witnesses testified in opposition stating that there is absolute no study shows if you
withdraw health care for 6 months on Medicaid that it will save the state any money. In addition, according to the supreme court rule on durational residency this bill would hinder the 14th amendment, right to travel, and the state cannot deny public benefits
for any duration of time. The Missouri College of Emergency Physicians, the Missouri Coalition for Behavioral Health Care, and Empower Missouri testified in opposition.
After hearing public testimony, the committee moved into executive session to consider two bills. House Bill 121, sponsored by Rep. Fredericks, would add psychiatrists to the list of health student loan repayments. This is to encourage qualified physicians
to practice in Missouri. The bill was voted Do-Pass with bipartisan support by a vote of 8-0.
The final bill to be considered was HCR 16, sponsored by Rep. Brattin. This bill urges congress to require physicians display costs of services provided. The bill was voted Do-Pass by a vote of 7-3.
