
THIS WEEK IN FLOOR DEBATE
The House on Thursday picked up and third read Rep. Marsha Heafner’s HB 65, HB 302 by Rep. Hill establishing the Blue Alert System, HB 230 which establishes the Hair Braiding Freedom Act, and then HB 126 which is still which establishes the Fairness in Public Construction Act. The Senate third read Rep. Rowden’s SB 237 that modifies definitions of “employee” and “physician employee” in actions against health care providers for personal injury or death and then Senator Onder’s SB 182 on project labor agreements.
COMMITTEE HEARINGS OF INTEREST
House Judiciary
The House Judiciary Committee heard Rep. Joe Don McGaugh’s HB 144 which would establish the Adult Health Care Decision Maker Act. The Missouri Hospital Association, VOICE STL, BJC Healthcare, the Missouri Bar, SSM Health Care, Kathy Butler with Greensfelder, Sheri Bilderdack all testified in support of the bill. The Missouri Family Policy Council testified against the bill while, the Missouri Hospice and Palliative Care Association, the Missouri Health Care Association, Missouri Right to Life and the Missouri Catholic Conference all testified for informational purposes. There is now a meeting at 4pm on Monday to further discuss any issues with the bill.
House Budget
On Monday, the House Budget Committee walked through the Missouri Department of Corrections budget recommendation. New department director Anne Precythe introduced herself as well as her leadership team. There was some brief discussion regarding the harassment charges against the Department, but Director Precythe wasn’t able to disclose too much as those cases are still caught up in litigation. She did tell the committee that she is going to be tackling these changes by taking on the merit system for employee promotion, implement a zero tolerance policy for sexual harassment and projects to improve moral.
The committee moved on to discuss the hospice rate increase, which did not receive any questions from the committee as it was described the $325,000 increase was tied to Medicare.
Senate Seniors and Families
This week the committee heard testimony SB 192 sponsored by Sen. Wallingford establishing the Senior Services Growth and Development Program was presented and essentially made a dedicated funding stream for the program that would attempt to mitigate budget decreases during 2008 and 09. General Revenue dollars would be reduced by the same amount the program would receive from this dedicated source. The Missouri Area Assoc on Aging and the Silver Haired legislature testified in favor and there was no opposition.
The committee then heard SB 334 sponsored by Chairman David Sater requiring assisted living facilities to provide residents with educational information on influenza was heard next. There was little discussion and the pharmaceutical lobby testified in favor with no opposition. This bill has been filed in years past and never quite made it across the finish line likely because most assisted living facilities likely do some form of this already.
House Rules
On Thursday the House Rules-Administrative Oversight Committee voted out Rep. Jean Evans HB 381. This bill allows a health care provider to disclose a deceased patient’s health care or payment records to the executor or administrator of his or her estate, or the power of attorney for health care that specifically directs the health care records be released to him or her after death. If no one has been appointed, and the deceased did not object to disclosure of his or her records in writing, the records may be released, upon written request, to his or her surviving spouse or personal representative, as specified in the bill. The bill specifies that disclosures under the bill cannot be inconsistent with any prior expressed preference of the deceased that is known to the health care provider.
Senate Seniors, Families and Children
On Wednesday morning, Senator Sater’s committee heard testimony on Senator Wallingford’s SB 192 which establishes the Senior Services Growth and Development Program and Senator Sater’s SB 334 which requires assisted living facilities to provide residents with educational information on influenza.
COMING UP…
On Monday February 20th the House Budget Committee will review the budget of the Department of Economic Development, on Tuesday the 21st they will hear from the Attorney General, the Department of Higher Education and the Department of Natural Resources. That Wednesday the 22nd the Governor and DESE will present their budgets, then on Thursday the 23rd, the Department of Agriculture and Department of Conservation will present their budgets. The final day for budget presentations will be on MOnday February 27th when the Judiciary, Public Defender and the General Assembly will present.
On Monday at 4pm there will be another meeting of interested parties in the Adult Health Care Decision Maker Act.
