Graffiti Gangster seriously injured avoiding paint fumes on train

Police say a man who suffered severe head and spinal injuries after leaning
out of a Melbourne train this afternoon is part of a graffiti gang.

They say the 25-year-old was struck by a pole when he put his head out of a
window to avoid paint fumes.

It happened between Spotswood and Newport in the city's west.

How did he put his head out of a train window? There are currently no
Hitachis running, and they're the only ones you can open anything on.
More likely the nitwit in question forced a door.

Hitachis are indeed running on the network. Seven six-car trains are
available, but they tend to come out at peak times only because,
although the drivers' cabs have been considerably upgraded, drivers
don't like them much. They aren't fitted with emergency intercoms.

I suppose we will now hear of a multi-million dollar lawsuit against the
train company because they didnt make sure the door/window could not be
forced open, or perhaps the agency responsible for track-side infrastructure
for having a pole in a place where someone could hit their head on
it...........the possibilities are endless. And going on some of the
ludicrous decisions in recent years in these sort of cases, he will probably
win.

That case has already happened, all the way to the Supreme Court of
Victoria. A key point of disputation was whether Connex had done
everything conceivable to prevent people getting more than a smidgeon
of head out of the windows. In the court case, the graffiti vandal was
sufficiently flexible to get his whole body out of the window, and
had been practising his moves for more than a year. As small as the
opening on a Hitachi window is, he was able to get himself out as far
as his waist, rotate and spray. Unfortunately, after 13 months without
a mishap, he forgot about stanchions and leaned out too far.

Contrary to Jim's assertion, above, he lost the case. The Supreme
Court found that Connex had no case to answer.

A negligence case would only work if somene accidently managed to place
themselves in a dangerous situation but not if they deliberately did so as
was the case with this cretin. All of these so called cases are urban myths
with no basis in reality. The one urban myth that amuses me and continues to
be propogated by petrol companies is the one that mobile telephones can
cause an explosion when filling up a car with petrol. Total bunkum but I
notice all the warning notices near petrol pumps still contain the warning
re mobile phones even though it has been totally discredited.
