driver indicted in fatal car-train collision

This is a follow-up to an article I posted a couple of months ago
regarding a grade crossing collision that occurred on April 1 in a
suburb of Rochester. After the passenger died, there was discussion
that the driver would be charged with manslaughter. That is what happened;
unfortunately, it made no difference in his passenger's outcome...

"A Rochester man said he was in a hurry to get his girlfriend to
work when he drove their car around railroad crossing gates and was
hit by a train.
"His girlfriend was fatally injured in the crash.
"A Monroe County grand jury yesterday indicted Eugene B. Brown,
37, of 40 Herkimer Street, charges of second-degree manslaughter,
second-degree vehicular manslaughter and driving while intoxicated in
connection with the accident on Coldwater Road in Gates on April 1.
"Brown's live-in girlfriend, 37-year-old Betty L. Schultz, died
of severe head injuries one day after the accident.
"While being treated at Strong Memorial Hospital, Brown
allegedly told a Gates police officer that he took Schultz to
Charlie's Coldwater Station, a Coldwater Road restaurant, to cheer
her up because she was having a child-visitation battle with her
ex-husband.
"The couple left the restaurant about 8 p.m. -- the same time
Schultz was due at work at a bar on Clarissa Street in Rochester,
Brown said. As they turned north on Coldwater Road, gates were
coming down at a nearby railroad crossing.
"When Schultz complained that she would be late, Brown drove
around two or three stopped cars and onto the tracks.
"Brown told police he never heard the horn of the 83-car freight
train that hit the car.
