Amending 2010 Return - Statute of Limitations

Hi,

I'd like to amend my 2010 1040, and I've read many articles on the statue
of limitations for filing an amended return, but am still unclear if I fall
under the 3 year limit, or the 2 year limit.

I filed on time in 2010, and received a refund. I now see that I missed
claiming both points paid and pre-paid interest on my original return, and
it's worth about $700. I'd like to amend. Can I?

Sorry, this is about a 2009 return, NOT a 2010 return.

Assuming your due date for the 2009 return was about 4/15/10 or so,
you can amend until 4/15/13.

I'll file an amended 2009 1040 (1040X for 2009). This also changes
(lowers) my taxable income with CA, for which I should file an amended
540X (CA amended return). CA will then send me a refund check with a
1099-G, Report of State Income Tax Refund.

I suspect that I must report this as income on my 2012 (since it will be
received in 2012) Federal return, but when I look at the Federal 1040s,
they seem to ask for state refunds for the year immediately preceeding
the year of the current filing year, not for any prior year. That is, it
looks like the 2012 1040 will ask for refunds received in 2012 for tax
year 2011, not any preceecding year. Regardless, I think I should
include any refund no matter what year it was for.

I ask only because I can see it could make a difference, esp. if your tax
bracket is different in different years. None the less, since a 1099-G
will be received, it must be reported.

File a 1040x for 2009
File a 540x for 2009
Include the refund amount on 1099-G, to be received in 2012, in my State
refunds line on my 2012 1040.
