Investigators have determined the Capitol Police officer who shot and
killed Ashli Babbitt during the U.S. Capitol riot should not be charged
with any crimes, a law enforcement source familiar with the investigation
told NBC News.

The Wall Street Journal first reported that police investigators have
recommended the officer not be charged, although the U.S. Attorney's
Office will make the final decision on the matter.

Babbitt, a 35-year-old Air Force veteran and ardent supporter of former
President Donald Trump, was shot during the Jan. 6 storming of the U.S.
Capitol.

The pro-Trump rioters wanted to stop the certification of President Joe
Biden’s win in the 2020 presidential election and were threatening members
of Congress and then-Vice President Mike Pence, who were evacuated as the
mob made its way closer to and eventually inside the Capitol Building.

Videos show rioters who made it into the building breaking glass on doors
near the House Chamber, which were blocked haphazardly from the inside
with chairs in an attempt to prevent the mob from entering. As Babbitt
tried to climb through the shattered glass, she was fatally shot by a
Capitol Police officer who fired at her once.

The officer, who has not been identified by Capitol Police or
investigators, "used clear appropriate use of force. It's not even a close
call," said the officer's lawyer, Mark E. Schamel.

The broken doors and a few officers were the only things separating the
mob from members of Congress, Schamel stressed. "I think it's his heroism
and his restraint that saved lives," Schamel told NBC News.

The Department of Justice announced last month that the Metropolitan
Police Department of the District of Columbia would investigate the
shooting, and the officer was placed on leave.

"This is routine, standard procedure whenever an officer deploys lethal
force. The U.S. Attorney’s Office for the District of Columbia is
overseeing the investigation," a Justice Department spokesperson said at
the time.

The Department of Justice did not immediately respond to a request for
comment.

A spokesperson for the Capitol Police said the department does not comment
on ongoing investigations.

A spokeswoman for the Metropolitan Police Department said the
investigation was not complete, and "it would be irresponsible to make an
investigatory assumption or to jump to any conclusion."

"There is no further update available to provide at this time," she said.

The U.S. Attorney's Office in Washington is investigating the attack on
the Capitol and leading prosecutions against an ever-growing list of more
than 150 people who were allegedly involved.

Four other people, including a Capitol Police officer, died as a result of
the Jan. 6 rioting.

Babbitt was a decorated security forces controller in the Air Force and
served multiple Middle East tours from 2004 to 2016.

Using the handle CommonAshSense, Babbitt’s Twitter account was almost
singularly focused on radical conservative topics and conspiracy theories.

Babbitt was a loyal Fox News watcher, according to thousands of tweets to
Fox News hosts, but she also engaged on social media with the conspiracy
site InfoWars. In 2020, Babbitt began to tweet with QAnon accounts and use
QAnon hashtags.

The day before the rally, she tweeted, "Nothing will stop us....they can
try and try and try but the storm is here and it is descending upon DC in
less than 24 hours....dark to light!”

On forums and platforms like Parler, where Trump supporters and QAnon
followers fled after being banned on Twitter and Facebook, many claimed
Babbitt’s death was faked. Others on the far-right have hailed Babbitt as
a martyr for the cause.

Chris Jacobs is no longer the presumed favorite for the 23rd
Congressional District seat in the November election.

Jacobs, a Buffalo Republican, was redistricted into the district
in late May and quickly became the candidate endorsed by the
district’s political parties and incumbent Republican
politicians, including Sen. George Borrello, R-Sunset Bay.
Borrello, who had previously signaled an interest in the seat,
told The Post-Journal on Friday that he is keeping his options
open at this point.

Borrello had previously endorsed Jacobs when the new district
lines were announced. That endorsement changed after Jacobs said
last weekend he would support a federal assault weapons ban in
Congress as well as raising the age on some gun purchases to 21,
limiting the capacity of ammunition magazines available for sale
and banning the sale of military-style body armor to civilians.

“Under the circumstances, I think it was probably the best thing
for the party and probably for him as well,” Borrello said when
asked by The Post-Journal for comment Friday afternoon.

The Justice Department has declined to prosecute two of Donald
Trump’s closest White House advisers — former chief of staff
Mark Meadows and social media director Dan Scavino — for
refusing to cooperate with the Jan. 6 select committee,
rejecting the House’s recommendation that the pair be charged
with contempt of Congress.

Matthew Graves, the U.S. Attorney for Washington D.C., delivered
the news to House Counsel Douglas Letter earlier Friday,
according to a person familiar with the correspondence.

The news came despite the Justice Department’s decision earlier
in the day to unseal charges against former Trump White House
trade adviser Peter Navarro with contempt of Congress for
similarly defying the select committee’s demands. DOJ charged
Trump ally Steve Bannon with contempt last year for refusing to
engage with the select committee.

Navarro was still in the White House when Trump tried to
overturn the election results, but Bannon was fired from Trump’s
White House in August 2017, although he remained in contact with
Trump in subsequent years.

Unlike Bannon and Navarro, Meadows and Scavino engaged in months-
long negotiations with the select committee, haggling over the
terms of potential testimony and the bounds of executive
privilege. Meadows also turned over thousands of text messages
and communications he had with members of Congress and other
White House advisers.

The select committee opted to pursue contempt charges against
Meadows and Scavino, however, after the negotiations failed to
result in plans for either of them to testify. Meadows had been
scheduled for a December deposition but withdrew at the last
moment.

Committee chair Rep Bennie Thompson (D-Miss.) and Vice Chair Liz
Cheney (R-Wyo.) called decision “puzzling” in a statement.

“Mr. Meadows and Mr. Scavino unquestionably have relevant
knowledge about President Trump’s role in the efforts to
overturn the 2020 election and the events of January 6th. We
hope the Department provides greater clarity on this matter,”
the statement said.

Meadows’ attorney George Terwillger III did not immediately
respond to a request for comment. Scavino’s attorney Stan Brand
did not immediately comment on the news. The U.S. Attorney’s
office for Washington D.C. declined to comment.

Though House Democrats welcomed the decision to charge Bannon
and Navarro, both were somewhat ancillary figures in Trump’s
orbit during the former president’s attempt to overturn the 2020
election. Meadows and Scavino, however, played central roles and
were at Trump’s side as a mob attacked the Capitol on Jan. 6,
2021 in support of his effort to prevent the transfer of power.

The New York Times first reported the Justice’s Department’s
decision not to charge Meadows and Scavino with contempt of
Congress.

ALBANY, N.Y. — Rep. Chris Jacobs has announced he will not seek
another term in Congress, after the Republican faced rising
backlash from the right following his announcement last week
that he would support new gun control measures.

“It would be an incredibly divisive election for both the
Republican Party and the people of the 23rd District,” Jacobs
said Friday afternoon at a press conference in Buffalo. “The
last thing we need is an incredibly negative half-truth filled
media attack funded by millions of dollars of special interest
money coming into our community around this issue of guns and
gun violence and gun control.”

Jacobs’ departure from the race will likely lead to a scramble
among Republicans in what will now be an open contest in New
York’s reddest seat.

Jacobs, a resident of suburban Buffalo, has spent the past two
years representing a seat in the northwest corner of the state.
Hours after new maps were released on May 21, he announced plans
to run for a new district along New York’s border with
Pennsylvania, which most closely resembles the seat that was
recently vacated by Republican Tom Reed.

In the aftermath of a shooting at a supermarket near his
district, he declared he would support measures such as a ban on
semiautomatic rifles and a new minimum age of 18 to purchase
firearms.

That quickly led to an uproar among his fellow Republicans.

“I was very surprised by Congressman Jacobs’ surprise
announcement,” state GOP Chair Nick Langworthy told reporters in
Albany earlier this week. “I think everybody was caught very
flat-footed by his adopting the Democrat position on gun
control.”

Langworthy has spent recent days taking steps toward a possible
campaign of his own.

There’s a chance the race could get crowded. Buffalo developer
Carl Paladino, the 2010 GOP gubernatorial nominee, told Spectrum
News earlier Friday he would run if Jacobs ended his bid.

Paladino was endorsed by fellow New York Republican Elise
Stefanik less than an hour after Jacobs bowed out.

“I am proud to announce my endorsement of my friend Carl
Paladino,” she said in a statement. “Carl is a job creator and
conservative outsider who will provide Western New York and the
Southern Tier with strong representation and leadership. Carl
will be a tireless fighter for the people of New York in our
fight to put America First to save the country.”

Any primary elections for the seat will be held Aug. 23. That
same day, there will be a special election to finish off Reed’s
term in the term in the overlapping seat. At least before
Jacobs’ departure, Republicans had been eyeing a placeholder
candidate for that special election.

The Justice Department has indicted Peter Navarro, a former
trade adviser to Donald Trump, for contempt of Congress after he
defied a subpoena from the Jan. 6 select committee.

After Trump’s defeat in the 2020 election, Navarro became an
early advocate for the former president’s false claims of
widespread election fraud and spearheaded efforts to overturn
the election. He’s been charged with two counts of contempt,
each of which carries a maximum sentence of one year in prison.

The U.S. House committee investigating the Capitol insurrection
subpoenaed Navarro in February and he tersely refused to comply,
claiming sweeping executive privilege over his efforts.
Following his appearance in court Friday afternoon, Navarro told
reporters he had been arrested “getting on the plane” to
Nashville and was put in handcuffs and leg irons.

“They just came with the full force of the federal government
and put the hammer down trying to intimidate me,” he said,
calling the Justice Department “wrong on all manner of counts.”
The former Trump adviser is scheduled to be back in court on
June 17 for his arraignment.

The indictment marks the first criminal charges related to the
Jan. 6 investigation against a person who was serving in Trump’s
White House during the former president’s attempts to overturn
the 2020 election results. Steve Bannon, who left the White
House in 2017 and similarly refused to comply with a select
committee subpoena, was charged last year with two counts of
contempt. He is set to go on trial in July. While the Justice
Department’s decision to charge both Bannon and Navarro is a
break from history, it’s even more rare for such cases to result
in convictions.

The contempt case is the latest effort by DOJ to bolster the
work of the select committee. And it represents another test of
the department’s handling of a politically explosive case — one
that intersects with congressional subpoenas, executive
privilege and longstanding DOJ internal precedent centered on
White House advisers’ immunity from compelled testimony.

Bannon has argued in court filings that his refusal to comply
was simply a reflection of DOJ’s longstanding guidance on
congressional subpoenas. But prosecutors rejected that
contention and said his case was not comparable to those
previously analyzed by the government.

Navarro, who has been dealing with the select committee without
a lawyer, publicly acknowledged receiving a grand jury subpoena
related to his refusal to comply last week. He filed a lawsuit
against the committee and Justice Department Tuesday, but a
federal judge told him Thursday to refile it to correct a series
of errors.

The select committee subpoenaed Navarro to testify in February,
but he told them he would refuse to comply, citing executive
privilege. The panel countered that its questions for him did
not broach any possible privileges related to his White House
work. Still, Navarro refused to appear. The committee held him
in contempt for that decision in April, asking the Justice
Department to pursue charges. The full House followed suit,
adopting the panel’s recommendation.

On the same day the committee held Navarro in contempt, members
expressed frustration that the Justice Department had not acted
on its contempt referral of former White House chief of staff
Mark Meadows. The House referred Meadows for contempt charges in
December, but DOJ has not acted on the referral.

The case will be overseen by Judge Amit Mehta, who is also
presiding over two other crucial Jan. 6 cases: the seditious
conspiracy trial against leaders of the Oath Keepers and a
sprawling series of civil lawsuits against Trump filed by
members of Congress and Capitol Police officers. Assistant U.S.
Attorneys Elizabeth Aloi and Molly Gaston are handling the case
for DOJ. Amanda Vaughn, the lead prosecutor in the Bannon case,
is also listed among the prosecutors.

The lead Republican negotiator for what would be the US Senate's
first gun control bill in a generation has walked out of talks
with Democrats.

Texas Senator John Cornyn has played a key role in drafting the
framework of a proposed firearms bill following mass shootings
in Texas and New York.

Leaving Washington, he said: "I'm through talking."

The lead Democratic negotiator said he was still hopeful the
bill could go to a vote next week.

But Mr Cornyn's walk-out has placed a question mark over the
legislation's future. Axios, a political outlet, reported
earlier on Thursday that conservative colleagues of the Texas
senator are frustrated at his handling of the talks and want
time to consider the text of any proposal before it is
introduced to the chamber floor.

The legislative window to pass a new law is narrowing as
November's mid-term elections loom.

A bipartisan group of senators has been working to draft the
text of a bill for lawmakers to vote on before they leave for a
two-week 4 July recess.

But they have become bogged down in recent days, as Democrats
and Republicans disagree on provisions that would strip certain
Americans of their guns.

Earlier in the day, he warned that time was running out to reach
an agreement.

"We're about run out of our rope here, and we got to make some
final decisions today if we're going to be able to get this on
the floor next week," he told radio host Hugh Hewitt.

The flurry of action comes after 19 young children and two
adults were killed at a school in Uvalde, Texas, less than two
weeks after a racially motivated shooting at a grocery store in
Buffalo, New York, left 10 dead.

Connecticut Democrat Chris Murphy and North Carolina Republican
Thom Tillis told reporters later on Thursday that the group was
still inching towards an agreement.

"To land a deal like this is difficult. It comes with a lot of
emotions," said Mr Murphy, who is leading the Democratic
negotiations.

"It comes with political risk to both sides. But we're close
enough that we should be able to get there."

Senators say disagreements remain over incentives for states to
enact so-called red flag laws, which allow police to seize guns
from people deemed dangerous. Talks are also ongoing to close
the "boyfriend loophole", which permits abusive partners to buy
guns.

If both the Senate and House of Representatives can agree on a
bill, it would go to President Joe Biden's desk to be signed
into law.

The Republicans still aren't serious about gun safety. I believe no
bill should be passed when it's as half hearted as this one appears to
