What gripes me is (as far as I can ascertain) they only put the check through
once (and called me to see if the balances were available twice ok already) but
on top of that they wanted to charge me an additional 11.00+ to "process" it
through a Credit Card or and ATM....huh? Balances were available, I told them
to send them through. They don't do that.
So, I will send them 2 more checks for the amounts plus 20.00 each now doesn't
that make sense? Sheesh! You can't do squat with cash hardly anymore........I
found this out after going to the manager of our local Safeway who got nasty
when I was standing there trying to pay for the damn things......everything for
Safeway goes through some clearing house in Phoenix.
Damned inconvenient for me.....

Check Fraud is a serious black nasty. The issuance of a check on an account
which is closed or has insufficient funds may constitute a crime for which the
maker of the check may be prosecuted.
You're getting off the hook nice and easy, because we have laws that acknowledge
the fact that there are folks who are not necessarily dishonest, just clueless
about managing their money.

I'd talk to a lawyer. I think that cash is considered legal tender
for any transaction and they can get in big trouble for refusing
it. I'm no lawyer but I seem to remember a case where a guy
went in to pay off something in pennies. The company tried
to refuse and got into major trouble.

I bet in this case it probably would have happened anyway. If I had of used my
ATM card, maybe the funds would have been available and maybe not........the
bank put a hold on a deposit I made because it was out of state, but showed I
had a sufficient balance to cover whatever it was I was writing out of the
account. Confused? You bet!

i had a bank *lose* a $10,000 deposit once...took me 2 weeks to
get it straightened out, but they finally found it & paid all
the bounced check fees. they refused to send letters to the
people i wrote checks that bounced saying it was thier fault
though. needless to say, i don't bank there anymore.
i haven't had checks for my current checking account for over a
year. i just use the ATM card.

It is a shame what banks have come to. All I can say is look for a
better bank. I haven't bounced a check in over 25 years, thanks to
small, personal, hometown banks. They would either transfer the money
out of a savings account to cover the check, or just float me the money
and charge an overdraft fee. The last time a bank bounced a check on me
because they were still processing my deposit, I was out that door so
fast it's probably still slamming.
You pay banks big bucks to handle your money. Big chain banks are good
at acting like they are doing you a favor for letting you be a customer.
It has gotten so bad that most people don't even know what customer
service from a bank is. For almost 20 years I banked with First Federal
Savings and Loan of McMinnville (only found in Yamhill County). They
offered:
Free interest-bearing checking accounts with $100 minimum balance.
Free ATM card transactions at their machines and other independent bank
machines in the state.
Free travellers checks.
Free destination currency travellers checks to any EU nation.
Credit card rates fixed at 5% over prime.
Free telephone banking.
The only reason I quit banking with them was that I moved 170 miles away.
In almost 20 years, they never bounced a check or screwed up my bank
balance. They once honored a NSF check to the IRS for over $12,000, and
charged me an $18 overdraft fee. If loyalty can be bought, they bought
mine with that one. It was flatly the best bank I ever used. My sister
and brother-in-law just refinanced their mortgage there for 6.75%.
Now I'm with a small credit union that is almost as good. Shop around.
You don't have to accept the abuse that the big banks heap on their
customers.

I am in the process of shopping. I do have to credit the bank, tho, they are
paying the merchant fees heaped upon me for this mishap......but I got such a
run around about it I am not real happy with these guys.
Safeway, in the most part, disappointed me the most......here I am, standing in
the customer service with cash in hand, to collect the checks and pay the fees
etc, and they won't deal with me. hmm, say I. Sure, I understand bounced
checks are a problem with businesses, thats why I was there as soon as I found
out about it and offered to take care of the problem. Not that I wanted to
scam them out of any money.....I got the goods, they got bad checks. Sorry!
So, now they have to wait until I ship the new checks out (I just received
their info from TeleCheck last night via mail) which will be today. I don't
like the implied threats made by TeleCheck either.
I just canceled a credit card that I hadn't used in over 6 months, for charges
to my account that are from a fraudulent company, so no way was I interested in
giving them a card number, to some schmuck over the phone? ha ha No and No they
cannot have my ATM account number either thankyouverymuch.
Oh Well, situation fixed.

If that is true, you seem to be innocent of any wrong. (However, in the fine
print of your checking agreement, you might find something that covers "holds"
and how they are added to your account.)
It seems the bank has tacitly admitted error by your stating in another post "I
do have to credit the bank, tho, they are paying the merchant fees heaped upon
me for this mishap..."
If you think you are truly innocent, and the bank made an error (and has left
you in the lurch, so to speak), you have a few options:
1) Spend some up-front money and get a lawyer and have the bank treated to the
same stress as you.
2) Contact the various news media. This may be more effective: businesses don't
like bad practices scrutinized closely.
3) Contact the BBB. It's easy to file a complaint.

Fortunatly the damage has been mitigated by me gettin' on it and rounding up
the 11 checks they bounced on the account.....several merchants ran the checks
back through to have them clear, I picked up several and got receipts for the
damages and presented them to the bank....who has credited my account. My real
satisfaction will come when I transfer my accounts to another institution and
keep only minimal money in this account for my convenience, not theirs.
Changing banks is a real pain.
But sometimes ya gotta do what ya gotta do.

Oh, ya see, I see cash as the green stuff and coins. Not checks.
I rarely write checks. In fact, I only use one credit card for
3 different folks, by telephone, and that number ended up being harvested
for fraud and that number is currently in the fraud department in
a foreign country. We got a new card number, but we're still
getting obnoxious phone calls from solicitors that hang up as soon
as the "woman" answers.

I got tired of paying out so much every year and went with a credit
union, too. The last straw for the bank came when they would not honor a
tobacco check. I had a long-standing account with them (my mistake) but
they would only give me the portion of the check in cash that I could cover
from my own account. I had farm bills depending on that cash.
When I went in to close the account I got the third degree about
withdrawing my money. They didn't want to hand it over! They called the
head office and wanted me to talk to someone there about my
"dissatisfaction" with their service and how they would like to make it up
to me and keep me as a customer. I let her have it. I told her that her
bank had not been in the service business for some years now. I told her I
didn't like it when they "lost" $500 one January and close to $1000 the next
January and wouldn't even talk to me about it (remember the ATM insider
thefts?). And the service fees on top of service fees! Sheesh! I told her
they would be hearing from a lawyer if they did not hand over my money
immediately and that there was nothing more to discuss.
Want to know what the kicker was? They had the nerve to charge me a
service charge the next month for that closed account. Swore I never came
in to the bank and closed it. So I went back loaded for bear. To the same
person. You better bet she made sure that account was closed and dead.

Yup. Similar Incident ended up costing me 70 bucks in fees everywhere _but_
at my bank.
Bank sent me a letter: We are returning your check for 5 bucks because you
only have six hundred bucks in your account, and we are charging you a
returned check fee of $0.00.
Gotta hate that they keep _two_ balances- the available and the ledger.
What burns me most about that was I did not do anything different-my
CC company moved the payment processing center to a different state,
and processed my check two days earlier.
And yes, I've always been aware that it is unwise to float a check, I just
didn't know I was.
