My wife just got a ticket for "failure to inspect" the car (sticker was 3
months overdue)
(in Princeton, NJ) with penalty $123 (hope no points, but not sure)
Is it worth fighting in court ? Is it even possible ?
I mean, what do you say to the judge, "I forgot" ?
Please advise. Any help is very apprecited.
Thank you,
Oleg.
I don;t know about NJ, but many places will dismiss the charge if you come
to court with an inspection and pay and dismissal or court fee.

Aren't points issued only for moving violations in NJ?

Is it worth pissing into the wind?

Yeah, but so is buying a lottery ticket. But how likely is it that you will
win?

What's the point? It's like pleading "guilty with an explanation". What
does the judge care about an explanation? Pay the man. And in that case,
you might as well just send it in. Saves you the time & trouble from going
into court.

NJ will NOT dismiss. You failed to have the car inspected, you violated the
law. Pay the fine. There are NO "Fix-It" tickets in New Jersey.
So then he pleads NOT GUILTY and it looses just appeal the decision.
I am sure higher level courts have better things to do than fool with
citations.
I did it with 2 infractions on one stop. I appealed, showed up in court and
when it was my turn they said we drop all charges without explanation and
judge said dismissed.

Probably. Is driving with an uninspected vehicle a moving violation in NJ? It
is in MA. (Parking a car on the street that is not inspected properly (if
required) is also a violation in MA.
Your wife's car was either inspected on time or it wasn't when she was
cited. So I don't see any benefit to trying to argue the ticket unless
the officer was wrong when it wrote that ticket.
The ticket will not carry any points, but feel free to verify that on
NJ's DMV web site.
Did this happen in NJ? I doubt it. For a failure to inspect ticket, the
OP can at best, waste his time fighting the ticket if the charge on the
ticket is accurate. The best way to avoid that type of fine in NJ is to
get your car inspected on time. In NJ, doing auto inspections is a quick
and easy task. I just had my car inspected at the Cherry Hill DMV
station and I was in and out in hardly any time at all.

It's been awhile since I've gotten such a ticket in NJ (over 30 years), but I
don't believe that it is.

In NJ, there is no difference. But the only way you're going to get a ticket
for an expired sticker in NJ (unless things have changed since I've been
gone) is if you are caught driving a car with one. They generally won't give
you a ticket just for parking on the street with an expired sticker. (Here
in California, you certainly WILL get a ticket for an expired year sticker
[on the licence plate] if they find the car parked on the street.)
Next time you'll get the damn car inspected before it's due won't you?
Wahhhhhhhhhhhhhhh!
