This lawsuit has huge implications. It is likely to change the face of
Usenet and the Internet in general. It has such far-reaching implications
that it wouldn't surprise me if it ended up going all the way to the Supreme
court as a freedom of speech issue should the defendants get the financial
backing to pursue appeals to that august level. But, working against them is
no civil rights organization with deep pockets would choose to associate
with such disgusting hateful rabble.
Mr. Novins has everything to gain and nothing to lose while the defendants
have everything to lose and nothing to gain. It is the classic win/win
situation for the good attorney, Novins. I bet the man plays a mighty mean
game of snooker! It really amazes me how clueless the defendants seem to be.
If it weren't for the fact that their attorneys have placed a gag order on
them under penalty of breach of contract, I'm sure these idiots would have
been here all along compounding the same folly that placed them in the
no-win situation they now find themselves in.
This tells me that their attorneys are taking things VERY seriously and
these attorneys know full well they will have to be very lucky and very
skillful as well as to gag order their clients if they expect to have even
the slightest chance of their clients being found not guilty. Theirs is a
close to impossible task and they know it.

It seems to me that Mr. Novins has pretty much gone off his rocker.
You'd be a better person if you didn't encourage him toward his
career's demise.
Is this the same Mr. Novins whose lawsuit targets a hundred different
people and a hundred different companies for one post made by one
individual? I believe he would fare better if he sued the individual
who made the post, but then what do I know, I'm just an anonymous
sockpuppet and your post was rhetorical, inflammatory, and intended
merely to provoke the defendants.
My bad!
It seems to me you shouldn't give a fuck as it pertains to AB's sanity given
your history in AUK. Right, my fellow "circle-jerk" nominee?
What's up with that, Miguel?

If a man is offered a fact which goes against his instincts, he will
scrutinize it closely, and unless the evidence is overwhelming, he will
refuse to believe it. If, on the other hand, he is offered something
which affords a reason for acting in accordance to his instincts, he
will accept it even on the slightest evidence. The origin of myths is
explained in this way. - Bertrand Russell
Quite apart from the suit you reference, the mob is out there with
pitchforks and torches.
The CDA itself was a notoriously bad POS bit of legislation - but parts of
it remain in force now.
So don't expect, as the article notes, that the proposed law will simply be
tossed.
And last week, SCOTUS re-affirmed the abominable FCC v. Pacifica decision
(George Carlin's seven dirty words censorship case.) This was completely
unexpected, and squeezed by with one vote.
The suit is obviously focused on a few reprobates unwilling to live within
the law, but the proposed law would take a blunt hammer to all speech.
It's easy to predict where this is going, the reaction to it, and so on.

That's not good news but it looks to me like the liberals are overreaching

More Big Brother liberalism seeping into our everyday lives. Live TV and
Radio can't really be live anymore. Everything's going to have to have a 15
second delay and a dump button just because somebody might say "Shit!" or
"Fuck!" Fucking ridiculous this fetish about certain words. Especially
words that are exclamations and have no relationship to the legal definition
of obscene.
When somebody exclaims "Shit" or "Fuck" feces and sex is the furthest thing
from their mind.

The way so many courts are leftest havens you can't count on anything being
tossed. That idiot George Bush didn't veto the unconstitutional
McCain/Feingold BCRA because he was counting on the Supreme Court
overturning it but one freaking liberal too many caused that not to happen
so we now have more legislation that stifles political free speech.

See comments above concerning the CDA.

There is a difference between the two for sure. The pendulum always swings
too far before it returns to a repositioned center and slowly but inexorably
that center moves left. This is why any democracy is doomed to failure after
a couple hundred years. People just don't live long enough and each new
generation wakes up in a world of fewer and fewer freedoms and more and more
statists. Pile more statists and fascists on each generation and the people
will accept it or at best beat it back to that which was the 'norm' when
they were in mid-life thinking they're doing some good and even this hard
work only slows down the inevitable leftist progression. Then it reaches a
point where it just all collapses into anarchy and then it perhaps will
start all over again. But nothing will be learned from it because people
live too short a life and people are ignorant, for the most part, of
history.
I'm afraid we have the misfortune of living in the end times of personal
freedom and personal responsibility.

I see it differently. Atlas doesn't have to prove who wrote the original. It
doesn't matter who wrote the original. What will matter to the jurors is how
the original (which is an *obvious* forgery that is easily recognized as
such by any of the Usenet savvy defendants) was used by the defendants (who
knew full well it was a forgery and even have stated the same here in this
group many times) to defame Atlas Bugged, his employees and his business in
general while representing it as genuine and factual.

Not yet.
Thanks, "Roz." I've been wondering what certain veiled threats and/or hints
had at their core.
I think I see the game now.
There is a countersuit already planned in which Novins and I will be named
as libelers for calling attention to Burnore's documented arrest record and
various and sundry tawdry asides. One problem I see with that is if Novins
cannot prevail in a case where a known forgery is used to libel him then how
can Burnore prevail when his arrest record is real and documented? You
cannot libel somebody with the truth.

Funny, I didn't mention Gary. I don't have any idea what are Gary's
plans, gweggie.
But I must say, as quick as you were to get all defensive and start
posturing, it sounds like Gary should file a counter claim. His case
would be a slam dunk, since what you wrote were outright lies and
republished lies in an attempt to damage Gary's business. Even after
you were informed of the facts in the matter you insisted on
continuing in your defamation of Gary and his business.
Since that is the basis for the novins soot with which you seem so

You don't read too well. You just don't seem to understand that Novins was
libeled using known bogus information while Burnore was 'truthed' with links
to original legal and court documents. So "WHEN" Novins prevails it sets no
prededent at all as you seem to imagine.

Troll or lunatic? Sometimes, I just can't tell, Greg.
Yes, I admit it. I posted it. I've known 'Atlas Bugged' for years. As a
matter of fact Atlas is another sock puppet of mine. It was all a set-up to
entice the AUKer bullies to use it to defame "Atlas" while I worked in

entire combined fortunes of 759 dollars and some change.

Negative publicity from a win? The only way he can't win is if he decides to

Yep, he an novins were informed multiple times tha their actions were

If push came to shove, it would be a simple enough matter to subpoena
Rachael Baldacci (now Carey) and her mother, Nancy Baldacci, and ask them to
testify on the facts of Gary's little misadventure. I doubt that any jury
would be very sympathetic to Burnore's counterclaim after hearing from his
victims. Truth is an absolute defense against libel and all that.
I'm certain Mr. Novins realizes this: I'm also pretty sure that Gary knows
this as well. He pled guilty to annoying and molesting a minor rather than
facing his victim in court: does he really want to deal with her testimony
now? And, of course, those documents would then become part of the public
record, thereby putting the lie to the constant "forgery" yammering from
Gropin' Gary and his Gang of Goons.
If Gary is smart, he'll make a settlement with Novins and slink away rather
than have public attention cast on his his lack of impulse control and Woody
Allen-esque ethics. But of course if Gary were smart he wouldn't have made a
pass at his girlfriend's 17-year old daughter. So it's anyone's guess how
this is going to turn out.
Thanks for all this valuable info !!
