Law suits out of control

H&R Block sent me TaxCut 2005, and will be charging me for the
software.
My question is, can they legally do that, if I never ordered the
software?

It seems unlikely the H&R Block sent you software and charged
you for it out of the blue without you consenting to the
purchase at any point.

Nevertheless, if that is indeed the scenario, then you don't
have to pay for it or send it back. Federal law prohibits
companies from sending unsolicited merchandise and demanding
payment for it.

Just out of curiosity, how do they intend to charge you for
it? Do they have your credit card number? If so, then how
exactly did they get it without you ever consenting to
purchase the software?

This may have something to do with it.
I bought Taxcut 2004 from Staples. I bought Taxcut State 2004 from
Hrblock.com. I did not consent to purchase the 2005 version(Unless it
was in the fine print when I purchased the State version online). Is
that possible?

I find it hard to believe believe they sent you a product and
didn't tell you how they expect you to pay for it. Have you
carefully read all the paperwork that was enclosed with the
product?

I think it's entirely possible that you told them to enroll
you in automatic delivery of next year's product when you
bought the product last year, and either didn't realize you
were doing it or forgot about it.

Given that you have a preexisting business relationship with
them, I'd say that rather than getting all huffy about it and
trying to figure out whether you can get away with not paying
for it, if you don't want it you should simply call them on
the phone and tell them you don't want it and ask how you can
send it back to them at their expense (since you claim not to
have ordered it).

According to a recent posting in misc.taxes.moderated, H&R
Block sends out unsolicited TaxCut CDs as a marketing ploy.
They don't charge you for it unless you try to install it, at
which point they prompt you for credit-card information so
they can charge you. Perhaps this is what happened in your
case, in which case the simple answer is that if you don't
want to pay for it, don't install it.

Check this thread....H&R may have sent the CD with your SSN on the
shrink wrap...
