Well, I came home the other day and found a note on my door saying
that I must call someone about the census. Excuse me, they apparently
crawled over my locked gate, or under my electrified barbed wire
fence. That's trespassing. I called the police and reported this.
The cops told me it's required by federal law that eveyone complete
the census forms. I asked the cops what happens if I refuse, and he
said he was not sure. That just proves how few rights we have in this
fucked up country. The whole "free country" thing is just a big
fucking lie.
What are they going to do, imprison me for refusing to give out my
identity. Fuck Em' Let em' lock me up. This is (supposed to be) a
free country. That means its my right to refuse to give out personal
information to anyone, and I will continue to refuse no matter what
they do.
To add insult to injury, I got a call this evening from this same
person from the census. I DO NOT ever answer the phone. I have an
answering machine. They left a message telling me I MUST contact
them, and MUST do so in the next week. EXCUSE ME, I have an UNLISTED
phone number. That means this Monday morning I'll be having some
nasty words with the phone company. Unlisted is unlisted, which means
DO NOT FUCKING CALL ME unless I give you my phone number. I'm also on
the NATIONAL and STATE " DO NOT CALL LIST".
What gives this moron the right to both trespass and violate my phone
number? And for that matter, if they were able to obtain all that
info about me, then they obviously already know my name, address, and
phone number, and can write it on their fucking census forms and leave
me the fuck alone.
This has me furious, and I'm ready to hire an attorney, no matter how
much it costs me.
What are my legal rights regarding this violation of my property ("No
Tresspassing" signs), and violating my telephone?
What CAN they do when I refuse to fill out their goddamn census forms?
Particularly after this harassment, It'll be a cold day in hell before
I cooperate with them in any capacity.

First of all, there is no known federal law making it a criminal act
refusing to fill out the form. In most cases, the census taking people
don't give a shit. If you're not home, they mark their little tally sheet
accordingly and move on to the next one.
Did you see your name on that oiginal mail? Most likely not. It's bulk mail
stuff and was probably addressed to "occupant".
When they did the census in 2000, I was a truck driver on the road. Saw the
form, but never filled it out. Never went to jail either. Not even a phone
call.

You get fined $100, or $500. There is no jail time.
So you get fined. Plead not guilty. It's going to cost them a hell of a lot

will) and address (also known to the census worker) can get your

Actually, if they can't get the information from the resident(s)
of the home, they'll ask neighbors, if any. If need be, they'll check
things like garbage set out on pick-up day to get a reasonable guess
as to the number of people living at the house.
A friend of mine is working for the census, so I do know a bit
about it.

Odds are, the information needed was acquired via your neighbors.
There is no way for me to KNOW this is the case, but it's far more
plausible than your presenting that the Feds don't care about you at

then you are legally and technically trespassing. As a matter of fact,
there doesn't even have to be a fence or gate. The mere fact that you

I point out that I've never know anyone to get sentenced to any
time for failing/refusing to pay the fine. That should stand as proof
that I have nothing to show that anyone has.
The fine is administrative, and not a criminal penalty, so you
can't mean that.

Unpublished and unlisted are two different things. Most people
opting for one will also opt for the other. This will prevent the
number from being printed in the phone books AND prevent 411 from

The troll claimed only one. If I have the two terms confused,
then so be it. This means that it's listed in the phone book but 411
can't access it.

In the troll post, the situation you want to exist does not
exist. The census worker wasn't there simply because he had a means
to do so, nor was he using it as a short cut.
The worker was there for a legal reason. As such, trespass is not
an issue.

BTW, had you read the census form, it states that if one doesn't
fill it out and return it, someone will stop by to get the information
required.
I would think that far more than 48 hours was given in the
notice, which should meet the law you reference. Or will you claim
that it must be 48 hours only?

A census worker isn't likely to enter the house uninvited. That
would probably be residential burglary (breaking and entering), and
not trespass, so your example fails.
A worker does have the legal right to be on the property if the
reason for being there is related to the census. No amount of your
wishing differently will alter this.

The census mails forms asking for the information it needs. Their literature
tells you what will happen if they don't hear from you.
