This is a formal Request for Discussion (RFD) for the creation of a
world-wide unmoderated Usenet newsgroup misc.legal.east-europe. This is
not a Call for Votes (CFV); you cannot vote at this time. Procedural
details are below.

RFD for unmoderated group: misc.cee.privatisation-liability.environment

Summary:

misc.legal.east-europe - discussion of environmental issues in Central
and Eastern Europe (CEE) privatisation and economic reconstruction.

This newsgroup is being set up under the 'Greening privatisation and
economic reconstruction' project supported by the EU Phare programme.

Rationale:

One of the biggest environmental protection challenges in Central and
Eastern Europe is to integrate environmental considerations into the
technological changes occurring during economic reconstruction.
Privatisation provides such an opportunity. Conversely, if liability
concerns, e.g., past environmental contamination, are not addressed at
privatisation, investors may overcharge governments for cleanup costs,
delay or back down from transactions, or end up being liable themselves
for unforeseen expenses related to environmental problems.

Several CEE countries are now quite advanced in cost-effective methods
for integrating environment into economic decisions, while many other CEE
countries are still at the initial stages of building the legal
structures, administrative frameworks and financial incentives for
dealing with environmental liability issues in privatisation and economic
reconstruction. There is a need for more intra-regional sharing of
practical experience and for technical cooperation concerning ways to
address environmental problems in privatisation and industrial
restructuring.

The proposed newsgroup would be a platform for serious and professional
discussions of the issues above. It is aimed at CEE privatisation and
environmental officials, though private investors, environmental
consulting firms, and the non-governmental community may also have a
strong interest in joining discussions.

The newsgroup takes as its starting point the participants in a series of
workshops supported by the EU's Phare programme and the Organisation for
Economic Cooperation and Development (OECD)

misc.legal.east-europe - is aimed at the talk newsgroup for discussion.
The subject area to be discussed is to be the environment. The region of
interest in this case is Central and Eastern Europe (CEE). The specific
focus of discussion is on practical aspects of addressing environmental
liability issues in privatisation and economic reconstruction.

Charter:

misc.legal.east-europe - will be an unmoderated newsgroup for the
discussion and sharing of information on policies and practical methods
for dealing with environmental issues in CEE privatisation and economic
reconstruction. Users will be able to ask counterparts in other countries
for suggestions when specific problems arise, and to post information on
the latest developments in their own countries on the issue. The focus
will be on pragmatic approaches to environmental issues in privatisation.

Postings from people from outside the CEE are welcome if they are
relevant to the special problems faced by privatisation and environmental
officials and the private sector in dealing with environmental issues
during economic transition, including privatisation.

This group will not be moderated

Advertising:

Short relevant professional advertisements (less than 4 lines) of events,
World Wide Web sites or other information directly associated with the
discussion topic are permitted. Blatant off-topic or commercial
advertising is not.

Binaries:

This group in general will not contain binaries, however, occasional WP
documents may be transferred.

Procedure:

This is a request for discussion, not a call for votes. In this phase of
the process, any potential problems with the proposed newsgroups should
be raised and resolved. The discussion period will continue for a minimum
of 21 days (starting from when the first RFD for this proposal is posted
to news.announce.newgroups), after which a Call for Votes (CFV) may be
posted by a neutral vote taker if the discussion warrants it. Please do
not attempt to vote until this happens.

All discussion of this proposal should be posted to news.groups.
