I am subpoenaing records from the SDPD for a traffic ticket. I filled
out a CR-125 subpoena for a trial declaration by mail case . The
information is sent sealed to the court from the police dept and is
opened only by the judge. The court will not allow me access to
records and they will not allow me to make a request. They says they
cannot do this because they do not know which judge the case will be
assigned to. The court told me that I can only have access to the
records if I lose and file for a appeal. So my question is if there
is another way to get access to the subpoenaed records before it is
heard. Or can make a request with the trial declaration by mail so
that I have the opportunity to respond by mail. Perhaps there is a
motion I can file...?
