"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

One state abortion ban that has already been tested in courts — and so far prevailed — is a Texas law known as Senate Bill 8.

It took effect last fall and relies not on the government but on private citizens to enforce. Opponents have couched it in terms like the "vigilante abortion law" or "bounty hunter law."

Red America seems like a prisoner who has just been just let loose from civilizational bounds when Roe v Wade was overturned. Some doozies they are considering are punishing the usage of roads to transport women seeking abortion, punishing women for travelling to civilized states to get abortions etc.

It looks like "cruel and unusual" only applies to federal laws.
