FA: Pooh & Friends Hand-Painted Wall Hangings

My fiancee is a wonderfully talented artist who is trying to start her
own
business doing decorative wall hangings of all kinds - and this is her
first set. The only reason for the reserve is to make sure that they
don't get sold for a price that isn't worth it for all the effort that
was put into them. Since she did all the cutting, sanding, designing,
and painting - we don't want to sell them for $10.00 since a lot of
effort (and love) went into these. Reasonable offers will be
considered - even if they don't meet the reserve.

Also, if this type of thing is appealing to you - she can custom
design whatever you'd like. Right now she is working on a Spongebob
Squarepants set of hangings. So, feel free to e-mail with questions
or what you would like to have done!

This auction is for a set of 7 decorative wall hangings. Each wall
hanging is cut out of 3/16" wood paneling and then beautifully hand
painted. The set of 7 characters consists of Pooh, Eeyore, Tigger,
Piglet, Rabbit, Owl, and Kanga w/ Roo. The characters vary in size:

* Pooh - 29" x 15"
* Tigger - 28" x 14"
* Rabbit - 28" x 14"
* Kanga w/ Roo - 30" x 22"
* Eeyore - 23" x 16"
* Owl - 27" x 13"
* Piglet - 17" x 8"

These are one of a kind, handmade pieces of art that would go great in
any nursery or child's room (or an adult's room for that matter).

My thought exactly. Disney can be VERY nasty about that sort of
thing. Sponge Bob isn't Disney (?? I don't think) and I don't know
how that will go.

Well, officially, Winnie the Pooh is NOT a Disney story, and I don't think
they have the rights over it all... I believe they have the rights to
certain representations of the Pooh, but not of other variations.

I have tried to research this, and came up with many other companies who
have copyrighted their own drawings of Winnie the Pooh. As long as it is not
a copy of the Disney pictures, I believe everything should be in order.

I wouldn't call protecting copyright being nasty. I don't think there
would be too much squawk if mom or grandma homemakes a wall hanging
with a licensed character on it. Its another for someone to set up a
BUSINESS making them and advertise them on the web. Using someone
else's material for commercial purposes without their permission or
paying royalties is stealing.

She might want to come up with some original images for her business -
I'm sure there would be a market for nice wall hangings of non-name
teddies, fairies, trains, dollies - generic nursery stuff with no fear
of copyright enfringement.

The original Winnie the Pooh is not Disney,of course, but the images she's using
*are* Disney's Winnie the Pooh. Also note, the OP posted his spam in
rec.arts.disney.merchandise.

Except the non-Disney cartoon drawings that are recognizable as Winnie
the Pooh are based on the work of the original illustrator Ernest
Howard Shepard who worked with A.A. Milne. The books AND the
illustrations are all still in publication and copyrighted.

And in any event, if you follow the link, you'll see that they're all
slavish recreations of the Disney renderings. (But being in
publication has nothing to do with copyright protection. Lots of
things are published without being subject to copyright protection --
the Bible and Shakespeare come to mind. In this case, with a British
publication, more than 75 years old, illos done by a man who was in
his 90s, I just don't know the answer with respect to original illos.
1960s Disney, OTOH, is a no-brainer.)
