Freelance writer: visa needed?

Hi

I have a question and was wondering whether someone could help.

I am currently on H1B.

I have been asked to contribute a short article for a local newspaper.
They have offered to pay me $50. My understanding is that would be
equivalent to taking payment for work and therefore in breach of my
visa status. They say it is a one off "gift" and so is ok. I am not
worried about the money as it is such a small amount.

1. Is it illegal to accept the money?
2. Even if I don't accept the money, is it illegal to do a 'free'
submission - does that count as work?
