No Charges for 15 Illegal Mexican Students in Under-aged Sex Case

LOS ANGELES — County prosecutors announced Wednesday that they
would not bring charges against 15 Venice High School students
arrested in March on sex-related accusations involving two
underage girls, saying there was insufficient evidence.

The arrests drew national attention and set off an anguished
debate about a case whose scope — at least as initially
described by the Los Angeles Police Department — shocked
parents, students and school administrators. The school brought
in counselors to offer support for its 2,000 students.

The terse announcement by the Los Angeles County district
attorney’s office that no charges would be brought raised
questions about the Police Department’s investigation and its
decision to move so aggressively.

Many of the students were arrested on campus and removed in
handcuffs. They were accused of engaging in sex acts with two
girls in their midteens, beginning in December 2013 and
continuing until the arrests. The boys were age 14 to 17.

The police said the sex in some cases was consensual. Consensual
sex with a minor is illegal in California.

At the time of the arrests, police officials said they had
enough physical evidence to ascertain that there was “forced
sexual activity against the will of the victim.” On Wednesday, a
spokesman for the department, Officer Tony Im, defended the
arrests, saying the investigators believed that there was
probable cause to act and turn the case over to the district
attorney’s office.

“They had enough probable cause to arrest them,” he said.
“Whether they are held to answer or not is not our doing.”

After being removed from school, the students were turned over
to their parents while the district attorney investigated.

Greg Risling, a spokesman for the district attorney’s office,
said that because the accused students were minors, he could not
provide details on the case or the investigation. “We can say
there was insufficient evidence to bring charges against these
15 teens,” he said.

The Los Angeles Unified School District said it would continue
its own investigation, which it said it began after notifying
the police about the allegations. The district said its
investigation included an evaluation of campus safety.

“Since the review is confidential, we can’t comment on specific
actions,” the district said in a statement.
