Thanks for the heads-up. Whether or not I am elected, I expect to attend that meeting. As you know, Milpitas has been a tough nut to crack regarding our waste stream. Only because of the statewide ban on single-use plastic bags will Milpitas join the surrounding cities in the ban.

A couple of Council candidates have talked about getting rid of the landfill, and the various odors (including compost facility, sewage plant and low-tide bay) have people talking. Plus, there will be two new Council members to replace the two being termed-out. So, this might be a good time to push the envelope in Milpitas.

Newby Island expansion hearing delayed in Milpitas

A previously scheduled public hearing on Tuesday night (Oct. 21) regarding proposed changes to the Newby Island Landfill has been delayed until further notice.

The hearing was scheduled for 7 p.m. at the Embassy Suites, 901 E. Calaveras Blvd., Milpitas. But on Monday, Milpitas City Attorney Mike Ogaz said the hearing had been delayed at City of Milpitas' request, since it fell on the same time and date as the Milpitas City Council meeting.

Ed Schreiner, a City of San Jose environmental inspector, confirmed the hearing has been rescheduled to Thursday, Nov. 6 at the same time and location.

City of San Jose's Department of Planning, Building and Code Enforcement Division -- Local Enforcement Agency was expected to present a proposed revision to the existing solid waste facility permit for the landfill located at 1601 Dixon Landing Road on the San Jose-Milpitas border.

Comments from the public, specific to the revision, were to be recorded at this meeting. Written comments may be submitted to the LEA until Wednesday, Nov. 12.

On Feb. 3, City of San Jose LEA received an application from Newby Island Landfill to review their permit and joint technical document to reflect their proposed operations. The application, according to San Jose city staff, was deemed complete and correct on Aug. 29

The revised permit contains the following proposed changes to Newby Island:

Increase the height/capacity of the on-site landfill to 245 feet mean sea level, up from 150 feet mean sea level.

Increase the capacity of the landfill by approximately 15.1 million cubic yards, excluding cover material.

According to state law, if any person files a petition or appeal challenging this approval and alleges that City of San Jose has failed to act as required by law or regulation during the approval process of the amendment application, the agency shall hold a hearing.

The application and accompanying documents for a revised solid waste facility permit for this landfill are available for review between 9 a.m. and 5 p.m. Monday through Friday at San Jose City Hall, 200 E. Santa Clara St., Fourth Floor, San Jose.

For more than a year, City of Milpitas and Newby Island Landfill and Resource Recovery Park operator Republic Services had negotiated in the hopes of finding an acceptable solution to ongoing odors and the potential for greater odor emissions, with no agreement.

City of Milpitas previously filed a lawsuit challenging the California Environmental Quality Act environmental impact report following a 2011 plan to expand the landfill. Milpitas' lawsuit is on appeal after a judge last December ruled against the city's claims.

Last month, City of Milpitas approved a request for qualifications in order to hire an environmental or public nuisance litigation firm with a goal to reduce all odors in Milpitas, with some in the city -- like Mayor Jose Esteves -- calling for the outright closure of the Newby landfill.
