Got a bit of an odd one here...
I asked a friend of mine to get hold of a copy of SBS 2003 for me...., as I
needed it for a new install on a brand new HP ML310 server...
He has sent me a genuine copy of MS Windows Server 2003 for Small Business
Server... The pack includes a MS install CD and a SP1 upgrade CD....? The
part number on the case is T73-00494....
I'm a bit lost here as in the past every SBS install I have done includes 6
CD's and goes through the install of Exchange etc....
This didn't ask me any of that....., and was only 1 CD...?
I've checked the part number on Google and it comes back as SBS 2003....???
This doesn't look right to me...., can any one tell me exactly what I have
here as I've never come across it before....

If it is in fact one CD (rather than DVD, and normally you get 6*CDs+DVD) he
_may_ have purchased a _license_ for SBS2003 but given you a media set of
'Windows Server for Small Business', otherwise known as 'Fresno, our poor
cousin'. Fresno is just the OS portion of SBS, similar limits but no
Exchange, etc... and much less in cost.

It's odd that they should even make the product..???. It looks like a copy
of Windows 2003 Server to me, but when you look at the id of the product it
says it is Windows 2003 Server for Small Business Server...
On the front of the CD case it says, Maximum of 15 Client Access
Licences..., so that would not be a problem for me, as it will be used at
home for a max of 3 users, but
I wonder if it could run as a Terminal Server...?, I know you cant do that
with the "proper" version of SBS, but would this be able to do it...., as
it's not really SBS...?

There is nothing else on the CD except a version of SBS that looks like Win
Server 2003....
It's odd that there are so many people/dealers selling it... I Google'd it
and you'd think that if the product was useless, why are there so many
copies out there...?
Who would be using the product...?, it's not SBS and it's not Win
2003.....????

one who buys it falls into the same trap I have...., and it seems to me your

I take it you're talking USBucks. Retail pricing for 'Windows Server 2003
for Small Business' (or whatever it's called, I don't think I've ever
actually seen the product. Got a scanner? CD and packaging please. mickm at
mickmalloy dot dyndns dot org) is not the same as SBS2003.
The CD DOES NOT say SBS2003. He has falsely advertised.
Bend him over and tell him to grab the soap. Fact is he probably knows of
the confusion because he purchased the wrong product himself, and is now
trying to offload it.

T72-01411 is the part number for Win 2003 SBS Standard. If that's what was
advertised, and T73-00494 was provided, then the seller *has* made an error
and recourse is possible.
So either the seller, or the purchaser, have made a mistake.
It wouldn't be hard to blame neither seller or purchaser - let's blame MS -
as they love to confuse us with similarly named products that are totally
different.
In the end though, it has to be buyer beware if you're purchasing software
in this manner.

In legal terms, that makes each a different product, and in practical terms,
they are different products.
The similarity in naming, and the reference to something being 'legal',
might be a clue towards a reason. Like, where Windows Server 2003 costs $x,
how can SBS, which includes WS 2003 *plus_a_bunch* cost less than plain WS
2k3? That's legal fodder - asking for trouble - and we know how folks like
to sue MS. And so, MS WS 2003 for Small Business Server might have been
invented to prove that SBS isn't built on WS 2k3, therefore the price
difference is justified. So, if SBS is built on MS WS 2k3 FSBS, then that
must be a product, and a product must have a SKU, and if there's an SKU
there must be a product, and eventually someone is going to offer that SKU
and that product for sale because that's what you do with products. If
you're confused, then the lawyers have done their job well ;-).
Or, the reason might be that it's a SKU for *really* small <minded> business
customers, want a server OS, but who don't want the features of SBS, and who
don't want to pay for WS 2003, and will never need more than 15 CALs, or
another server to co-exist with this one.
In any event, do be careful out there - there are a ton of unscrupulous
vendors hawking the SKU because they see an opportunity to exploit the
naming similarities.

Colin carries some degree of fault. The package clearly states 'Maximum 15
Client Access Licenses (CALs); 5 included' on the front of the CD case. This
should have set an alarm bell, SBS2003 is limited to 75 CALs.
MS are the main 'culprit'. The _idiocy_ of not only producing this product
but effectively naming in such similar manner to SBS2003 has been pointed
out to them on numerous occassions.
This post was written before other replies or some other 'more direct'
queries were sent to me. It has been sitting onscreen waiting for Colin's
link to the seller's webpage.
Thankfully, I can't find an AU price for 'Fresno', either that or I am
suffering from the same misdirection as Colin. Seems to me that Colin has
paid a reasonable price for SBS, but been given 'Fresno'.

Just jumping in here wrt rescinding the deal.
This really depends on the specifics/particulars of what was transacted
meaning your conversation/email to and from the seller. Also the terms
of Paypal.
Genearlly, if you asked for SBS2003, and he says ok he has SBS2003,
but gives you that confusing part number, you have stronger ground.
Esp. if the offered price is very close price of SBS2003.
This is because there was no meeting of minds, so was never an agreement.
Something in Paypal gives you leeway here?
It's a disadvantage that you've opened the package, worse if you've
activated.
Since Microsoft did help confuse all of us by making this available in the
broad market your options may be to attempt to rescind, then get the seller
to support your claim to Microsoft for the correct product - original
receipts
needed. You may be slightly poorer for shipping and handling fees but I
believe
given sufficient documentation and time, you'll be able to right the
product.
Contact your local Microsoft consumer support if you've received the retail
package, which looks like you did.

I've opened the plastic outer wrapper but not installed or activated the
software... It is a 100% legal copy, so at least it's genuine...
I don't know if I have any come back here... I know when you fight things
via Paypal it his very hard to win..., and they are never on your side when
there are grey areas..
I need my arse kicking for not checking things better and looking to trade
with proper official dealers...

Advertising the correct part number but a confusing description probably
isn't going to help your case.
Then again the seller might have got stuck with it the exact same way.
