Microsoft Action Pack subscription

Hi,

I have a client who uses the action pack. They are wondering if they
don't continue their subscription next year, whether the licenses from
it they are currently using will lapse or would still be valid.

You should probably review the license terms, but my understanding is
that MAPS licenses remain active for the duration of the subscription
and once the subscription expires so do the licenses.

This is different from most other Microsoft licenses.

I challenge you to show me that in writing.

The requirement for an Action Pack subscription is to be at least a MS
"Registered Partner" (or higher). As such, you are then entitled to
subscribe to the AP and use software from the AP subscription to run your
internal business.

Nowhere does it say that a Registered Partner needs to continually upgrade
the AP. Renewing the AP subscription is entirely up to the Partner's
discretion. Simply because a MS Partner decides not to renew his AP
subscription does not mean that he cannot continue to use the previously
acquired software in the operation of his business, per the licensing terms
and agreement, as a Registered Partner, if he still holds that status.
Naturally, no new AP software may be downloaded/shipped without a current AP
subscription. But the previous software would not become "invalid" to a
currently registered MS Partner who obtained the licensing legitimately and
is using it within the terms of the AP agreement (promoting MS business).

I kind of thought the same thing, but I don't know, which is why I didn't
originally respond. I remember working at one place in the mid 90's using
the AP. We were a VAR and partner, offering Microsoft OSs on our products.
We used MAPS to run the business, specifically NT4 and Exchange. We did
renew it annually, but I don't remember if that was a requirement or not. I
can't remember what else out of it we used. Matter of fact, I learned
Exchange 40, 50 and 55 off of it. :-)

FWIW, I found the following, quoted from the following link, however it
doen't specifically address what exactly happens if you don't renew.

I do know, and this link confirms it, that it's only for VARs and related
type of IT businesses (and only IT businesses) that are Microsoft Partners,
and is only meant for the IT business, and can't be distributed or re-sold
to customers, and is only site specific.

What is the return and cancellation policy?
There are no refunds after you have accessed the MAPS software download
site. If you cancel your subscription, the software licenses are no longer
valid and you must uninstall all copies of the software. Contact the
Regional Service Center if you have questions. You will need to provide your
name, company name, mailing address, and MAPS order confirmation number.


As with anything MS licensing, they are the authority on licensing. If you'd
like to challenge them to describe where your limitations are spelled out,
I'm sure they'd be happy to do so and up to the challenge.
