since I sent him. what pull you have.?
thanks for the update. and the settlement on the being sued part. I was
informed by some one that handles these agents a lot and thought he was
sued.

It's JUST a picture!  The character resembles a million other people as much as it does Bill Gates.  As an artistic
work, it's totally up to the producer (owner) of the image to have any sort of issue as to what it's used for.  If Bill
was made free to the public domain, that gives free license to what the image might be used for.  It's REALLY no big deal.
As far as MS attorney's requesting that the image be taken down, I reckon it was simply ONLY a request.  I don't believe they would have had sufficient legal grounds to achieve anything but the suggestion would need to be taken seriously as even a threat of a restraining order on business trade could cripple a small company.

Enough opinion from me anyway.

This poses an interesting question, too. If one company is prohibited by law from doing something, what prohibits the owner from starting another company that is not under that restricton and doing it?

The images of Peedy, Merlin, etc.. were also "just" pictures on the MS
Agent Webring and Microsoft demanded that they be taken down.

You must have missed the comments that came with that.
It's up to the the producers of the image to have any issue as to what it may be used for. In that instance Microsoft
is simply exercising their rights (under the Universal Copyright Convention & the Berne Convention) to enforce their
ownership. That is logical and good business sense. Those characters are a marketing tool for MsAgent technology and
consequently must be controlled in order to prevent association with any marketing that may infer negatively.

I heard of people being plagued by the family of John Wayne to remove
likenesses of him from their websites. Not sure if it is true or not

his family for there is no telling what kinda repercussion that would
bring.
so I keep it under my hat for the most part. but I think johns boy is

The characters (and names) are public domain by virtue of precedent.
No issues there. Anyone else could make their own versions too.

The names can't be copyrighted.

Now... I'm sure you have heard the expression "everyone has a double." If
that is true (and I have seen people who were the spitting images of people
I knew), what is the case then? Can the look alike be sued because "you have
my face."? Do you see how ridiculous this can get? <G>

Like I said before, when are people going to return to simplicity and get

deal. It is possible for a human character to copyrighted. Obviously this protects actors who depend on such for their
living. I guess the royalties are still flooding in on John Wayne imagery, so perhaps they've got legal grounds to
restrict use of his imagery too.

same! it's one's attitude towards money. SOlomon said that "money is for a
protection "(Ecclesiastes 7:10) but he placed a higher value on WISDOM.
Interesting how Phillips' translation renders 1 TI 6:9,10: "For men who set

Altogether interesting and simultaneously bizarre that what began as a
